CAPTAIN KENNEDY'S CERTIFICATE CANCELLED.

(in TELEOEAPH. —OWN COEEESPONDENT). AncKEANi), Last Night. The Nautical Court gave a lengthy decision in the Stella.-Waitemata collision. The Court decided that the loss of the Waitemata was due to her being run down by the Stella, caused by the negligence- in navigation by her master, Robert Kennedy, whose certificate is cancelled, as it had been proved that Captain Kennedy was under the influence of l'tjuor. The master of the Stella waß not justified in not having a man on the louk-out, and in leaving the deck in charee of a seaman. This latter alone was tuffiuient to prove negligence in navigation. Though Captain Kennedy's cei'tiriuate is cancelled, the Governor might return it whenever the Marine Department considered he could be trusted again. All the Waitemata certificates were returned. Captiin Kennedy .stated he had absolutely no funds, aud no order was made as to the costs of the enquiry.
