KARL V. KUSABS.
AWARD OF THE ARBITRATOR. These actions, which have been dragging on for tome months, have at last been settled, Mr W. J. Hunter, the arbitrator having given his award. The claims were lor alleged damage by a fire spreading from the defendant", on to the plaintiff's land. They were first brought in the Magistrate's Court at Te Awaniutu, and then removed to the Supreme Court at Auckland, and finally dealt with at Ohaupo on Friday, 17th December, before Mr W. J. Hunter as arbitrato-. Mr A. Swai brick appeared for the plaintiffs and Mr L. O'Neill for the defendants. The cases were as follows :—Annie Karl v. Henry Kusabs and Emily Kusabs, claim £l2B 3j, for damage to timber, firewood, fence, grass and p ; gs ; Joseph Karl v. Henry Kusabs and Emily Kusabs, claim £6B 2s, for damage done to timber, firewood, peach trees and grass. The award of the arbitrator was as follows :—Plaintiff is awarded £5 13j paid into court ; each party to pay his own costs in both courts and arbitration aud one-half cos's of reference and award.
