Two indecent assault case defendant's remanded
The following cases were heard by Judge Van Dadelszen in the Ohakune District Court last Thursday. Policesergeant Russell England of Ohakune appeared for the prosecution and Traffic Officer Bruce Carr of Turangi appeared for the Ministry of Transport.
Indecent assault James Dean Ohlson, 24, unemployed of Raetihi, was remanded without plea to appear in the Ohakune District Court on February 23 on two indecent assault charges, one against a sixteen year old girl and one against a thirteen year old girl, at a swimming hole in Raetihi in January 5 this year. Defending charges An eighteen year old Raetihi man was remanded to appear in the Ohakune District Court on March 23 to defend three charges to which he pleaded not guilty and for sentencing on one charge, that of cultivating cannabis plant, to which he had pleaded guilty. The not guilty pleas involved one charge of behaving in a threatening manner in Duncan Street, Raetihi, and two charges of indecent assault ( one involving a thirteen year old girl and one involving a fourteen year old girl) at a swimming hole in Raetihi on January 5 this year. Counsel: P. Brown. Hunter remanded Nevil Philip Bain, 34, hunter of Mangeitei Valley was further remanded until March 23 on two charges to which he
had pleaded not guilty in the Ohakune District Court on "December 15 last year. These charges related to the alleged theft of and damage to property owned by complainant William Paul Cornelius of Raetihi. Disqualification extended Kirk John Betty, 19, unemployed of Ohakune, appeared for sentence on a driving while disqualified charge to which he had pleaded guilty and remanded for a probation officers report and sentence in the Ohakune District Court December 15 last year. He was convicted and fined $200 and disqualified from driving for a further six months from August 29 when his current disqualification expires. He was given a final warning about driving while disqualified. Defendant was also ordered to place his finances under control of his probation officer and undertake a twelve month term of supervision during which time he must accept such counselling and treatment of alcoholism as directed. Counsel: D.G. Harvey. Stone throwing Denise Cribb, 22, seasonal g arden hand of Rangataua, pleaded guilty to assaulting the proprietor of the Ruapehu Hotel, Raymond Parr, on December 16
last year. Court heard how defendant had kicked complainant when he attempted to stop her throwing stones at the hotel's windows after she had been evicted from the public bar. She was convicted and sentenced to sixty hours of community service. Driving charges Raymond Brian Ellis, 20, mechanic of Ohakune, pleaded guilty to one charge careless use of a motor vehicle and one charge of driving with excess blood alcohol in Goldfinch Street, Ohakune, on November 20. Both charges arose out of an incident when the car defendant was driving left the road and crashed into Hammonds Bookshop. On the careless use charge he was convicted and fined $75, court costs $65. On the excess blood alcohol charge he was convicted and fined $400, court costs $65 and ordered to pay medical fees and analyst expenses. He was disqualified from driving for nine months. No licence Tania Maria Gray, 24, housewife of Raetihi, was convicted and fined $120, court costs $65 on a charge of driving a motor vehicle in Grey Street, Raetihi, on July 23 last year without ever having had a drivers licence of any kind. On the charge of driving a vehicle which did not have a current motor vehicle licence, she was convicted and fined $100, court costs $65. Assaulted a female Brabyn Grey, 22, forestry worker of Raetihi, pleaded guilty to a charge of assaulting a female on January 30 at Raetihi. He was convicted and remanded on bail to appear in the Ohakune District Court on March 23 for a probation officers report and sentence. Counsel: P. Brown. Failed to appear Herman Charles Gurnick, 29, of Wanganui
failed to appear for a defended hearing on several Ministry of Transport charges including: supplying false information, careless use of a motor vehicle, excess breath alcohol and driving while disqualified in Ohakune last year. Court heard that prosecution witnesses went in court for the defended hearing and a warrant for arrest of defendant had been issued in October last year. A fresh warrant for arrest was issued last Thursday. Cannabis pipes Brenda Leigh Haworth, 22, unemployed of Raetihi, pleaded guilty to the possession of three pipes for the purpose of committing an offence under the Misuse of Drugs Act, namely the smoking of cannabis on January 6. She was convicted and fined $175, court costs $65. Driving charges Stanley Rangi Herewini, 61, retired of Raetihi, pleaded guilty to one Ministry of Transport charge of following too close, one failing to stop following an accident and one of failing to ascertain injury. The charges arose out of an incident in New Plymouth on May 7 last year when defendant's vehicle had run into the back of another vehicle at a "Give Way" sign. Very little damage was done and no injuries occurred. On the charge of failing to stop he was convicted and fined $150, court costs $65. On the charge of failing to ascertain injury he was convicted and fined $100, court costs $65 and disqualified for six months. On the charge of following too close he was convicted and ordered to pay court costs of $65 and disqualified from driving for the same six month period. Defendant was however, granted a limited licence to drive his wife to hospital or the doctor's surgery in the event of an asthma attack. Counsel: D.G. Harvey. Remanded Melville John Hunt, 37, contractor of Ohakune, was remanded without plea to appear in the Ohakune District Court on February 23 to answer one charge of using insulting words on December 19 last year. Excess alcohol Andrew James Kebbell, 21, student of Palmerston North, pleaded guilty to a charge of driving with excess blood alcohol
in Ayr Street, Ohakune, on September 13 last year. Two other charges, one of careless use and one of failing to provide information following an accident, were withdrawn by consent. On the guilty plea charge he was convicted and fined $400, court costs $65, ordered to pay $34 medical fees and $54 analyst expenses. He was disqualified from driving for twelve months. Counsel: P. Brown. Old and new charges Bruce Francis Liddle, 39, farmer of Horopito, was further remanded until March 23 on three charges to which he had pleaded not guilty in the Ohakune District Court on December 15 last year. Three charges related to the complainant William Paul Cornelius of Raetihi. On a new charge of stealing a cattle beast valued at $750 from William Paul Cornelius on January 27, defendant was remanded without plea to appear in the Ohakune District Court on February 23. Arrest warrant Brian Michael Ludeman, 38, unemployed of no fixed abode, did not appear to answer a charge of breaking and entering a building (Wholesome Foods in Clyde Street, Ohakune) on December 15 last year with intent to commit a crime therein. This was the same day that he had appeared in court last December on the same charge. A warrant for his arrest was issued. Plea changed Raymond Anson Mahe, 22, forestry worker of Raetihi, was to have defended three charges on which he had appeared in the Ohakune District Court on December 15 last year and to which he had pleaded not guilty. However, when he appeared last Thursday, he changed the plea on a charge of theft to guilty and the other two charges were dropped by consent. On the charge of theft by finding of a Victa motor-mower, two edge trimmers, a grease gun, rake and broom and an American jerry can under the hedge of a neighbouring property, the Raetihi Bowling Club, he was convicted and sentenced to eighty hours community service. Counsel: D.G. Harvey. Disorderly behaviour George Ashford Pekamu, 21, unemployed of Ohakune, pleaded guilty to be-
having in a disorderly manner in the Ohakune Hotel on January 18 this year. Court heard how defendant had tried to enter the hotel, where a live band was performing, without paying the $10 admission fee. When he was refused entry defendant caused damage to hotel property amounting to $79.50. He was convicted and fined $250, court costs $65, ordered to pay $79.50 reparation and given a final warning. Assault sentence Stephen Charles Pue, 18, unemployed of Marton, appeared for sentencing on a charge of assault to which he and pleaded guilty at the December hearing at the Ohakune District Court. He was convicted and sentenced to six weeks periodic detention in Marton and to a twelve month term of supervision. Counsel: P. Brown. Excess alcohol Bernard Athol Rhodes, 57, farmer of Ohakune, pleaded guilty to a charge of driving with excess blood alcohol on State Highway 49 between Ohakune and Raetihi on December 9 last year. He was convicted and fined $300, court costs $65 and ordered to pay $87 medical fees, and $54 analyst fees and disqualified from driving for six months. Counsel: D.G. Harvey. Three charges Jason Taiaroa, 18, unemployed of Raetihi, faced a total of three charges when he appeared in Court last Thursday. On the charge of possessing an offensive weapon (a spiked leather wrist band) in Seddon Street, Raetihi, on January 6 he pleaded guilty and was remanded on bail to appear on February 23. On the charge of stealing a packet of
Winfield cigarettes valued at $3.50 from the Starline Garage Raetihi, on January 4, he also pleaded guilty and was remanded on bail to February 23. On the charge of behaving in a threatening manner likely to cause violence he was remanded without plea to the Ohakune District Court on February 23 when he is due to appear for a Probation officers report and sentence on the other two charges. Counsel:D.G. Harvey. No conviction Wendy Ann Walmsley, 19, housewife oi Ruatiti, was discharged without conviction when she appeared on a charge of stealing five bales of hay on January 31. Court heard how the hay bales had fallen from a truck the previous night and were left lying on and beside the roadway until the following morning when defendant found them and placed them on her vehicle to take home and feed her house-cow. As her counsel explained defendant had no idea that she was thereby committing the offence of theft by finding and had no criminal intent. In discharging her without conviction, Judge van Dadelszen agreed with counsel that her plea of guilty was probably not the most appropriate one under the circumstances. The hay bales were subsequently claimed by and returned to a neighbour. Counsel: D. G. Harvey. Name suppressed A Raetihi man was convicted and further remanded without plea to appear in the Ohakune District Court on March 23 on two charges involving driving while disqualified and of using a document to obtain a pecuniary advantage. He was granted continued interim suppression of name.
