Ohakune District Court

The following cases were heard by Judge E.W. Unwin in the Ohakune District Court last Friday. Sergeant Mark O'Donnell o f Wanganui and Sergeant Brett Jones of Taihape appeared for the police prosecution. Traffic Officer Ian Harrison of Ohakune appeared for the MoT. Alcohol and driving Hemi Biddle, 26, storeman of Ohakune, pleaded guilty to one charge of careless use of a motor vehicle in Seddon Street, Raetihi, on February 26 and to

one charge of driving with excess breath alcohol on the same date at the same place. He also pleaded guilty to two similar charges arising out of an incident in Napier in May last year. On the first two charges he was convicted and fined $300 and $340 respectively. He was also fined $65 court costs on each of the four charges and disqualified from driving for 12 months. Counsel: P. Brown. Arrest warrant Phillip Henry Bowring, 28, unemployed

of Raetihi, was to have appeared on a charge of being a person who, having been released on bail at the Ohakune District Court on April 14 failed, without reasonable excuse, to attend personally at the Ohakune District Court sitting on May 12 as specified in the Notice of Bail. A warrant for arrest was issued in lieu of summons. No licence Nathan John Donghi, student of Raetihi, pleaded guilty to one charge of driving a motor vehicle (a motor cycle) on Ohura Road on January 4 with no driving licence, one charge of driving a vehicle without registration plates and one charge of using a vehicle which had no current WoF. On the charge of driving without a licence he was convicted and fined $100 and on each of the other two charges he was convicted and ordered to pay court costs of $65. Trespass Krishane Hiroti, 21, of Raetihi, pleaded guilty to a charge of driving without a driver's licence o n November 15 last year and was convicted and fined $100. To another charge of wilful trespass at the Oasis Hotel in Waiouru he also pleaded guilty. Defendant told the Court that he had accompanied his mates to the hotel after a rugby match on May 28 but,

knowing that he had been banned for two years, he hadn't had a drink. He was convicted and fined $100, court costs $65 and ordered t o make immediate payment. Nine charges Henry Lewis Haitana, 31, unemployed of Wanganui, appeared for sentence on a total o f nine charges dating back from December last year to April this year. The charges included wilful trespass, offensive behaviour, theft, breach of bail, escaping from custody, rer sisting arrest, disorderly conduct and refusing to leave licensed premises. Court heard from counsel how defendant's anti-social behaviour had started when a death occurred last December which had greatly affected him but defendant had n o w come to terms with this situation and had not re-offended for the past two months. He was sentenced to 18 months supervision and 6 months non-resi-dential periodic detention. Counsel: Jim Rota. Mistaken identily claim Phillip Jerry Hiroti, 28, unemployed shearer of Raetihi, made a brief appearance to complain that the two charges of driving while disqualified and driving with excess breath alcohol against him was as a result of mistaken identity. "The police are making a big deal out of this ... the guy respon-

sible is outside the Court now ... he is Garth Hiroti." Judge Unwin stood the case down and ordered defendant to stay in the vicinity of the Court so that police could check out his claim and sort the matter out before he was recalled. However, some time later, when police had investigated the claim and defendant was recalled, he did not reappear. A warrant for arrest was then issued. False alarm Kenneth Thomas McCann, 20, apprentice plumber of Raetihi, pleaded not guilty to a charge of knowingly giving a false alarm on February 13. A second charge of deceiving a member of the Fire Service was withdrawn. He was remanded on bail to appear in the Ohakune District Court on August 5 for a defended hearing. Counsel: D.G. Harvey. No licence, helmet Tony Leslie Paris, 18, unemployed o f Rangataua pleaded guilty to one charge of driving without a licence never having had a driver's licence, one charge of using a motor vehicle without a current licence for that vehicle ( a motor cycle) and one charge of not wearing a safety helmet. All charges related to February 28 when defendant was stopped by a traffic officer in Rangataua. On the first charge he was convicted and fined $100, on the

third charge he was convicted and fined, court costs of $65 and on the second charge he was convicted and discharged. Counsel: P. Brown. Burglary John David Frederick Pikari, 29, unemployed market garden worker of Raetihi, appeared for sentence on four burglary charges and one charge of unlawfully taking a bicycle to which he had pleaded guilty at the April sitting of the Ohakune District Court. In issuing defendant with a final warning and sentencing him to 12 months supervision Judge Unwin said that he wished publicly to thank Mr and Mrs Taiaroa of Raetihi for assisting in the rehabilitation of defendant who was now on a benefit and was able to pay board. Defendant was ordered to make reparation of $450. Counsel: D.G. Harvey. Driving charges Steven Charles Pui, 18, unemployed of Raetihi, pleaded guilty to one charge of driving without a licence never having had a driver's licence, one charge of using a motor vehicle in Seddon Street, Raetihi, with insufficient tread on the tyres and one charge of driving a motor vehicle which did not have a current WoF on February 13. On the first charge he was convicted and fined $100 and on each of the other two charges he was convicted and ordered to pay court costs of $65. He was disqualified from driving for 3 months. Driving charges Henry Murray Taura, 19, shearer of Raetihi, pleaded guilty to two charges brought by the MoT. On the charge of driving without a current driving licence he was convicted and fined $100, court costs $65

and on the charge of driving a motor vehicle with an expired registration sticker he was ordered to pay $65 court costs. He was disqualified from driving for 3 months on the first charge. No licence Dallas Waara, 18, labourer of Raetihi, pleaded guilty to driving a motor vehicle (a light roller) on Shannon Street, Ohakune, on December 2 last year without having had a driving licence at any time. He was convicted and fined $100. Alcohol charges David Warren Wairi, of Raetihi, pleaded not guilty to a charge that he drove a motor vehicle with excess breath alcohol at Invercargill in March 1987. Court heard how, as a result of a request for identification from the MoT, the Invercargill Traffic Office had supplied a photograph of a person who claimed he was David Warren Wain at the time of his arrest last year. The photograph was of a person who was not the defendant. After confirming with defendant that he was not the driver in question, Judge Unwin dismissed the informa tion. Careless use Te Aroha Anna Wattai, 44, finance supervisor of Lower Hutt, pleaded not guilty to a charge of careless use of a motor vehicle on the Parapara Road on February 21. She was remanded to appear in the Ohakune District Court on August 5 for a defended hearing on her not guilty plea. Alcohol charge Raymond Kairimu Rapana, 40, shunter of Raetihi, pleaded guilty to one charge of driving with excess breath alcohol in Pitt Street, Raetihi, on March 4 and to one charge of driving a motor vehicle which did not have a current WoF on that date. On the first charge he was convicted and fined $350, court costs $65. On the second charge he was convicted and ordered to pay $65 court costs. He was disqualified from driving for 6 months. To a charge of driving without a driving licence never having had such a licence, defendant pleaded not guilty and was remanded to appear in the Ohakune District Court on July 8 for a defended hearing.
