OHAKUNE DISTRICT COURT

The following cases were heard by Judge P.J. Toomey of Palmerston North in the Ohakune District Court last Thursday. Police Sergeant Neil Coker and Traffic Officer Ian Harrison appeared for the prosecution. ★★★ Peter Wayne Arahanga, 24, solo parent of Raetihi, pleaded guilty to a charge of driving with excess breath alcohol in Seddon and Duncan Streets, Raetihi, on 5 June. He was convicted and fined $250, court costs $55 and disqualified from driving for eleven months. Counsel: D.G. Harvey. ★★★ Robert Michael Cudd, 22, unemployed of Ohakune, pleaded guilty to * one charge of possessing cannabis seed, one charge of possessing utensils for the purpose of committing a crime under the Misuse of Drugs Act and one charge of stealing a telephone valued at $54.45 being the property of Telecom NZ. He was remanded on bail to appear in the Ohakune District Court on 24 September for a probation officer's report and sentence. Counsel: D.G. Harvey. ★ ★★ Jason Myles Hern, 18, community trainee of Ohakune, pleaded guilty to a charge of possessing cannabis plant. As a first offender he was convicted and fined $125, court costs $55. Dean Hiroti, 26, unemployed shearer of Raetihi, pleaded not guilty to one charge of causing intentional damage to a glass door at the Ruapehu Hotel in Raetihi on 31 July and to a charge of using obscene words to patrons at the Ruapehu Hotel on the same date. He was remanded on bail to appear in the Ohakune District Court on 26 November for a defended hearing. ★ ★★ Garth Hiroti, 22, unemployed of Raetihi, pleaded guilty to a charge of possession of cannabis plant material on 12 June. Court heard how defendant had chosen to visit the wrong place at the wrong time because that was also the night the police had chosen to execute a search warrant. Defendant was found to have a small quantity of cannabis in his possession. He was convicted and fined $125, court costs $55. Counsel: P. Brown. ★ ★★ Phillip Gerry Hiroti, 27, unemployed of Raetihi, pleaded guilty to one charge of driving with excess breath alcohol in Ayr Street, Ohakune, on 31 July. On this charge he was convicted and fined $150, court costs $55 and disqualified from driving for 8 months. On a charge of common assault he was remanded without plea until 24 September. Adam Haitana, 20, shearer of Raetihi, appeared for sentence on four charges of burglary and one charge of unlawfully taking a motor vehicle to which he had pleaded guilty at last month's District Court hearing. Because of the unavailability of information which could have been of material significance in pronouncing sentence, this case was further remanded to 24 September. Counsel: P. Brown. ★ ★★ Emmanuel Howe, 22, unemployed of no fixed abode pleaded guilty to a charge of assaulting Bruce Moran in Clyde Street on 6 August. Court heard how defendant went to the 'assistance' of a co-offender who was kicking and punching the complainant following an altercation in the Ohakune Hotel. On this charge he was convicted and remanded to appear in the Ohakune District Court on 24 September for a probation officer's report and sentence. Counsel: D.G. Harvey. Defendant later appeared to defend two other charges: one of theft and one of receiving - see report on defended cases next week. ★ ★★ Allan William George Mills, 21, unemployed labourer of Palmerston North pleaded guilty to a charge of possessing cannabis plant but not guilty to a charge of selling cannabis plant on

25 July. He was remanded on bail to appear in the Ohakune District Court on 26 October for a defended hearing. In the meantime he was ordered to reside in Palmerston North and report to the Palmerston North police every Tuesday and Friday. ★ ★★ George Ashford Pekamu, 19, unemployed of Ohakune pleaded guilty to assaulting Bruce Moran outside the Ohakune Hotel on 6 August. Court heard how, following an altercation in the hotel, defendant had followed complainant into the street and pushed him to the ground where he was repeatedly kicked. When complainant attempted to rise to his feet he was punched and once more fell to the ground cont'd onp. 24

Defendant was convicted and remanded to appear in the Ohakune District Court on 24 September for a probation officer's report and sentence. Counsel: D.G. Harvey. ★ ★★ Robert Daniel Pickery, 20, unemployed of Ohakune, pleaded guilty to one charge of possession of cannabis plant on 27 July and one charge of having in his possession utensils for the purpose of committing a crime under the Misuse of Drugs Act. On the first charge he was convicted and fined $150, court costs $55. On the second charge he was convicted and fined $175, court costs $55. ★★★ Amber Lamer Mary Powhare, 20, solo mother of Wanganui, appeared for sentence on a charge of possession of cannabis to which she had pleaded guilty last month. Court heard how defendant had been found with half a cigarette of cannabis so presumably the other half had already been smoked. "But this is no hanging matter" said Judge Toomey in convicting and fining defendant $100, court costs $55.

Barry Richards, 22, trainee musician of Raetihi, was further remanded until 26 November to defend a charge of receiving a JVC video cassette stereo valued at $600 to which he had pleaded not guilty in the Ohakune District Court on 26 March. The case has been adjoined several times pending the outcome of proceedings being taken against an alleged co-of-fender in another Court. Counsel: P. Brown. ★ ★★ James Jason Taiaroa, 17, single of Raetihi appeared for sentence on a charge of burglary from the Whakangahau Trust in Raetihi on 4 June to which he had pleaded guilty at last month's hearing. In convicting and sentencing him to 75 hours of Community Service and ordering him to make reparation of $244 to the Trust at the rate of $10 per week, Judge Toomey told defendant it was a 'mean offence1 committed against people who have endeavoured to help you. "Your probation officer tells me you are good at and want to play rugby but I hope it won't be for a prison team," added Judge Toomey.

**★ Raphael Meterei Tinirau, 24, unemployed of Raetihi, appeared for sentence on one charge of possession of cannabis, one charge of possessing instruments for the purpose of committing a crime against the Misuse of Drugs Act, and one charge of cultivating cannabis. In imposing sentence Judge Toomey said that whilst some may dispute

this, medical evidence shows that the smoking of cannabis destroys cell and brain tissue. On the first charge defendant was convicted and fined $125, court costs $55, on the second charge he was convicted and fined $125, court costs $55 and on the third charge he was convicted and fined $250, court costs $55.
