OHAKUNE DISTRICT COURT
The following cases were heard by Judge L. Laing of Wellington in the Ohakune District Court last Thursday. Sergeant Brett Jones of Taihape appeared for the police. ★ ★ ★ Denis Mason Peihopa Bishop, 18, unemployed garden worker of Ohakune, appeared for sentence on one charge of robbery and on one charge of depositing dangerous litter by deliberately breaking a beer bottle on the roadway. He had been remanded from last month's Court sitting for a probation officers report and sentence. He was further remanded to 1 1 December to see if the community based programme on which he has embarked will have the desired effect. Counsel: D. G. Harvey. ★ ★ ★ Paul Stanley Eaton, 33, bush contractor of Raetihi pleaded guilty to a charge of assault committed in Raetihi on 27 September. Court heard how complainant, who lived within the borough boundary, heard a shot fired on a neighbouring property. It was only later when he thought that the shot had been fired near his young son and dog who were in the adjoining sheep paddock that he decided to confront the complainant who was the occupier of the neighbouring property. The confrontation led to the assault charge. In convicting and fining defendant $400, court costs
$38.50, Judge Laing said that defendant had jumped to a number of conclusions and committed an assault without checking out the facts. Because it was committed about two hours after the shot was fired it was not a spur of the moment thing and could not be excused as a natural reaction to a situation in which his son's safety was endangered. Harvey. ★ ★ ★ Vernon Leslie McLeod, 17, sickness beneficiary of Karioi, appeared for sentence on a charge of stealing batteries and biscuits valued at $8.02 from New World Supermarket on 20 October. He had pleaded guilty at last month's sitting of the District Court. In convicting and discharging the defendant Judge Laing ordered him to pay $30 towards the cost of prosecution and said that as a young first offender he was being given a chance of avoiding the slippery slope into a pattern of crime. Counsel: D. G. Harvey. ★ ★ ★ Vernon Wayne Mott, 23, fitter welder of Ohakune, was remanded at large without plea to appear in the Ohakune District Court on 1 1 December to face a charge of assault. Counsel: D. G. Harvey. ★ * ★ Angelina Rapana, 30, general hand of Raetihi appeared on one charge of causing bodily injury by carelessly using a motor veh-
icle on SH 49 between Waiouru and Ohakune on 7 June and one charge of refusing to provide a specimen of blood on the same date when required to do so by a registered medical practitioner. She had appeared on these two charges at last month's Court sitting but had been remanded at large without plea in order for her legal counsel to make further enquiries into the circumstances of the case. At last Thursday's sitting she entered a plea of not guilty to both charges and was remanded to appear in the Ohakune District Court on 1 1 December for a defended hearing. Counsel: P. Brown. ★ ★ ★ Julie Olive Tamatea, 17, solo parent of Ohakune, appeared on two charges of theft to which she had pleaded guilty last month. She had been remanded for a probation officer's report and sentence on one charge of stealing clothing valued at $210 from a clothesline on 22 September and to another of stealing clothing valued at $80 on 24 September. Court heard how the offences arose out of need and for no other reason. In convicting defendant on both charges and ordering her to pay $290 in reparation at the rate of $10 per week, Judge Laing said that while theft under any circumstances cannot be condoned this was defendant's first offence and was unlikely to occur again. Darren Te Huia, 18, unemployed of Upper Hutt appeared on one charge of depositing dangerous litter and one charge of disorderly behaviour. These offences occur red in Thames Street, Ohakune Junction on 26 August when defendant was seen to throw a beer bottle onto the sid'e of the road and to lash out at a passing police vehicle with a studded belt. On the charge of depositing dangerous litter he was convicted and fined $30, court costs $38.50. On the charge of disorderly behaviour he was convicted and fined $100, court costs $38.50. * ★ ★ Sandra Jane Ball, Thomas Henry Ball and Elizabeth Ann Gardner were represented by legal cousel when they were due to appear again on the ongoing overstaying charge. Failing an appearance by the Department of Immigration, counsel asked for a further remand until January 1987. Judge Laing, who knew the circumstances of the case well and was aware of the many court appearances said, when the further remand was requested: "Are we talking about January next year?" Counsel replied: "Yes, sir." Judge Laing then asked: "Wouldn't it save a lot of Court time and cost if we made it January of the following year?" Defended cases next week.
