SPECIAL ORDER NO. 5.

Made by the Council of Hobson County by resolution adopted at a special meeting of the said Council held on the eleventh day of May 1892 confirmed at a subsequent meeting held on the fifteenth day of June 1892 (public notice of such subsequent meeting having been duly given on the 13th, 20th and 27th days of May and the 3rd day of June by notification in the Wairoa Bull a newspaper circulating in the district and notice thereof having been duly given to each member of Ihe said Council and 9. copy of the Special Order and By-law' having been deposited at the Council Chambers Aratapu and having been there open to the inspection of the public during office hours for thirty days immediately preceding the meeting to wit from the third day of May 1892 to the .fifteenth day of June 1892) and sealed with the Common Seal of the Body Corporate called The Chairman, Councillors and Inhabitants of Hobson County on the sixteenth day of June 1892. Whereas by “ The Counties Act 1886” Section 311 it is enacted and provided that the Council of every County may make Bylaws (inter alia) for regulating either in proportion to the weight of the load or the number of animals employed, the width of the tires of wheels which shall be used fey all vehicles whether plying for hire or not, within the County. And w hereas by Section 304 of the said Act it is provided that By-laws shall be made only by Special order,

Now therefore it is resolved that this Special Order shall take effect on the sixteenth day of June 1892, and the Council of Hobson County in exercise and pursuance of the powers vested in the Council of every County by “ The Counties Act 1886 ” doth hereby by Special Order ordain as.follows. 1. This By-law shall be called and may for all purposes be cited and referred to as “ By-law No. 5 of Hobson County ” and shall apply to the whole County' and; couie into force within and throughout the whole County on the fourth day of July 1892. 2. The width of the tires to be used by all vehicles whether plying for hire or not while on unmetalled roads within the Gounty shall in proportion to the weight of the load be as follows: (1) Every vehicle carrying a load the weight of which shall amount to or exceed Four tons for each pair of wheels Eight inches. (2) Every vehicle carrying a load the weight of which shall amount to less than Five hundredweight for each pair of wheels One and a quarter Inches. (3) Every vehicle carrying a load the weight of which shall amount to more than Five hundredweight and not more thanTen hundred weight, for each pair of wheels Two and a half inches. (+). Every vehicle carrying a load the weight of which shall amount to or exceed Ten hundredweight but shall not. exceed One ton for each pair of wheels Three inches. (5) Every vehicle carrying a load the weight of which shall amoiu-nt “o or exceed One ton but shall not exceed Two tons for each pair of wheels Six-inches. (6) Every vehicle carrying a load which shall amount, to more than Two tons for each pair of wheels Eight inches. 3. Any person (1) Who shall use on. any vehicle carrying- a load whether plying tor hire or not within the County or who being the owner or other person having the control of any such vehicle shall cause, permit, or suffer to be used by such vehicle, tires or a tire of less width than that hereinbefore appointed for every vehicle carrying a load of the weight carried on or bv such vehicle. ' A. “ ; (2) Who shall cause,or procure to be carry or carried on or by any vehicle whether plying for hire or not-within the County or who being the owner, driver or other person having the control of any such vehicle shall permit <sr suffer to be carried on or by such vehicle any load the weight of which shall exceed the weight which may under the pro visions hereof be carried by vehicles using tires of the width used by such vehicles
