HOBSON COUNTY,
BY-LAW No. 4. SI >E DIAL OBJ ) ER Made by the Council of Hobson County by resolution adopted at a Special meeting of the said Council, held on the tenth day of February, 1802, confirmed at a subsequent meeting held on the sixteenth day of March, 1892 (public notice of such resolution and of such subsequent meeting and of the timet® wit the Second day of May 1592 when this Special Order should take effect having been duly given by notice published on the 19th and 26th days of February and the 4th and 11th days of March 1892 in the ‘ Northern Advertiser,’ a newspaper circulating iw Hobson County, and a copy of such order and Bylaw having been deposited at the office of the Council and having been open to the inspection of the public at the said office as specified in the notification for the thirty days immediately preceding the meeting, and notice of such meeting having been given to each Councillor) and sealed with the Common Seal of the Body Corporate called “ The Chairman Councillors and Inhabitants of Hobson County ” on the sixteenth day of March 1592. Whereas by Section 304 of “ The Counties Act 1886 ” it is provided that By-laws made by the Council of a County shall be made only by a Special Order. And whereas by Section 311 of the said Act it is provided that the Council may from time to time make, alter, and repeal By-laws to provide for the licensing of public vehicles and to prevent the use of such as are unsafe or insufficient, to provide for the inspection of public vehicles to provide for the licensing and numbering of all vehicles plying for hire for the carriage of passengers or goods, and general or regulating the use of public vehicles, and to prescribe the lights to be carried by every vehicle, public or private, and their position on the vehicle. Now therefore it is resolved that this Special Order shall take effect on the second day of May 1892, and that by Special Order and in exercise and pursuance of th° powers vested in the Council of every County by “ The Counties Act 1886 ” the Council of Hobson County doth ordain as follows :
1. This By-law shall be called and may for all purposes be cited and referred to as “By-law No. 4 of Hobson County ” and shall apply to the whole County. 2. No vehicle shall ply for hire for the carriage of passengers or of goods within Hobson County unless the same shall be duly licensed so to ply in manner hereinafter provided. 3. Every person who, being the owner or one of the owners of any vehicle, shall desire to obtain a license for the same shall sign and deliver to the Clerk an application, in writing in the form of the First Schedule stating the name and place of abode of such person and of every owner of such vehicle, and describing the vehicle for which such license is required, stating the number, and width of the tires, of its wheels, its carrying capacity for passengers or goods, as the case may be, whether such license is required for the carriage of passengers or of goods, and the term for which such license is required. Every such application shall be accompanied by an amount in money or Post Office Order equal to the sum payable to the County Fund for the license for which application is made. 4. Every such application shall be considered by the Council at the first meeting held after the same shall be received by the Clerk, and the Council may call and hear such evidence as it may think fit, and may cause an inspection of such vehicle to be made, and may in its discretion grant or refuse such applicatif n. Every license granted under the provisions of this By-law shall be signed by the Chairman and shall continue in force (unless suspended or revoked) for a term of either One Month or Twelve Months from the date of issue as may be expressed therein. Every such license shall specify the name of every owner of the vehicle in respect of which it is issued, the number of the license (but so that no two licenses issued hereunder shall bear the same number) the number of passengers or the quantity or weight of goods which maybe carried in such vehicle, and shall sufficiently describe the vehicle in respect of which it is issued and shall state clearly whether such vehicle is licensed to ply for the carriage of passengers or of goods. 6. If upon the consideration of any applicant for a license under the provisions of this By-law the Council shall bo of opinion that the carrying capacity of the vehicle in respect of which such application is made is less than that stated therein, the applicant may then amend his application and a license may be granted on such aniended application, but failing such amendment the application shall be refused. 7. The sums to be paid to the County Fund for licensing of vehicle under the provisions of this By-law shall be as follows :
For every license granted for the term of One month from the date of issue, Two shillings and sixpence. For every license granted for the term of Twelve mouths from the date of issue, One Pound. 8. Every license issued hereunder shall be duly entered by the Clerk in a registry book to be provided for that purpose and kept at the office of the Council. 9. The owner of every vehicle licensed under this By-law shall cause to be painted or marked and to be kept painted or marked in some conspicuous place on such vehicle in legible letters and figures of at least one inch in length and of proportionate breadth the words “Hobson County.” the name of such owner, the number of the vehicle corresponding with the number of the license granted therefore, and if such vehicle be licensed to ply for hire for the carriage of passengers, the number of persons which according to the license may be carried by such vehicle at length in the following form : “ Licensed to carry passengers.” Or if such vehicle be licensed to ply for hire for the carriage of goods Ihe words “Licensed to cany goods.”
10. The Council may as often as it may deem necessary cause an inspection to be made of all or any vehicles licensed under this By-law and if any such vehicle shall at any time be in a condition unfit for public use the Council may give notice to that effect to the owner and if after such no I ice such owner shall ply, or permit, or suffer any person to ply for hire with such vehicle while in a condition unfit for public use, the Council may suspend for any stated time or may revoke the license granted in respect of such vehicle. Any such notice may be served upon such owner personally or by leaving the same at his last known place of abode or by posting the same addressed to him at his place of abode as stated in the application for such license. If the owner of any vehicle in respect of which a license shall have been granted hereunder shall fail to cause to be painted or marked and to be kept painted or marked on such vehicle in some conspicuous place the words and figures which he is hereinbefore required to cause to be painted or marked and kept painted or maiked thereon, or if any such person shall commit any breach of this By-law the Council may suspend for any stated time or revoke the license granted in respect of such vehicle, and no license while suspended under this section shall bo deemed to be of any force or virtue. Any license revoked under this Section shall immediately cease and determine and the vehicle hi respect of which such license shall have been issued shall thereupon cease to be licensed hereunder. 11. If any person who (1) Shall ply for hire for the carriage of passengers or goods with any vehicle for which no license hereunder is in force or without having painted or marked thereon in manner hereinbefore provided the words and figures hereinbefore required to be so painted or marked (2) Being the owner of any vehicle for which no license hereunder is in force shall permit or suffer the same to be used to ply for hire for the carriage of passengers or of goods (3) Being the owner of any vehicle for which a license hereunder is in force fails to cause to be painted or marked and to be kept painted or marked thereon in manner hereinbefore provided the words and figures hereinbefore required to be so painted or marked and kept painted or marked (4) Being the owner, driver, or person in charge of any vehicle licensed hereunder shall carry therein or thereon any greater number of passengers or larger quantity or weight of goods than that which according to the license may be carried in and by such vehicle (5) Shall ply for hire for the carriage of passengers or of goods with any vehicle in respect of which a license shall have been issued hereunder while such vehicle is in a condition unfit for public use. (6) Being the owner of any vehicle licensed hereunder permits or suffers it to ply for hire for the carriage of passengers or of goods whilst in a condition unfit fer public use or (7) Having purchased any vehicle licensed hereunder causes or suffers the same to ply for hire for the carriage of passengers or of goods without having first procured an indorsement of the license as herein provided or without having removed the name of the former owner from such vehicle and having painted his own name thereon shall for each such default, or omission be guilty of a breach of this By-law and on conviction shall forfeit and pay such sum not exceeding Five Pounds as to the convicting Justices shall seem fit.
12. Any person who shall purchase any vehicle iu respect of which a license under this By-law shall be then in force may apply to the Council for a transfer of such license to himself, and the Council may thereupon cause a memorandum to be indorsed on such license stating that such purchase has been made and that the Council allows a transfer of the license to the purchaser. Such person shall remove the name of the former owner from the said vehicle and paint his own name in place thereof. Until such indorsement of the license and alteration of the name no such vehicle shall ply for hire for the carriage of passengers or of goods. 13. No vehicle whether licensed hereunder or not shall be led or driven over, across or along any public road within the County after sunset and before sunrise unless such vehicle shall have at least one light fixed and properly burning on the right hand side of such vehicle, and on the right hand side of the driver thereof. Any person who shall, drive or lead any such vehicle or who shall cause, procure, allow, suffer, or permit any such vehicle to be driven or led over, across or along any such public road after sunset and before sunrise without having a light burning as aforesaid, shall be guilty of a breach of this By-law and on conviction shall forfeit and pay such sum not exceeding Five Pounds as the convicting Justices shall think fit. FIRST SCHEDULE. I. of being owner (or one of the owners conjointly with ) of a certain vehicle to wit a having wheels the width of the tires of which is inches (such further description as can be given) am! having carrying capacity lor do hereby apply to the Council of Hobson County to license the said vehicle to ply for hire for the carriage of within the County for Month from the date of the issue of such license.
