BY-LAW No. 8* SPECIAL OP PEE Made by the Council of Hobson County by resolution adopted at a Special meeting' of the said Council, held on the tenth day of February, 1892, confirmed at a subsequent meeting held on the sixteenth day of March, 1592 (public notice of such resolution and of such subsequent meeting and of the time t® wit the Second day of May 1892 when this Special Order was :o take effect havingbeen duly given by- notice published on the 19th and 26th. days of February and the 4th and 11th days of March 1592 in the ‘ Northern Advertiser,’ a newspaper circulating iu Hobson County, and a copy of the order and Bylaw having been deposited at the office of the Council as specified in the notification, and having been open to the inspection of the public during office hours for the thirty days immediately preceding the meeting, and notice of such meeting having been given to each Councillor) and sealed with the Common Sea.l of the Body Corporate called “ The Chairman Councillors and Inhabitants of Hobson County ” on the sixteenth day of March 1892.
Whereas by Section 303 of “ The Counties Act 1886 ” it is provided that the Council of every County may from time to time make alter and repeal By-laws for any of the purposes for which the Council is empowered to make By-laws and whereas by Section 20 of "The Slaughterhouses Act 18S7 ” the Council of a corporate district is empowered to make By-laws for the regulation and inspection of Slaughter-houses and for the good government of all parties using- the same and for fixing- the fees for and the conditions on which licenses shall bo granted. And whereas by Section 304 of " The Coun ties Act 1886 ” it is provided that By-laws shall be made only by Special Order. Now therefore it is resolved that that this Special Order shall take effect on the Second day of May 1892, and that by Special Order and in exercise and pursuance of the powers vested in the Council of every Corporate District by “ Tim Slaughter-houses Act 1887 s ■’ and its amendments the Council of Hobson County doth ordain as follows 1. This By-law shall be called and may for all purposes be referred to and cited as “ By-law No. 3 of Hobson County ” and shall apply to the whole County. 2. In the construction of this By-law the term “ the said Act ” means “ The Slaughterhouses Act 1877” and the several terms set forth within inverted commas in Section oof the said Act shall have the meanings thereby assigned to them respectively. 3. The sum to be paid to the County Fund in respect of every license to be issued by this Council under the said Act as the fee for the same shall be Twenty Shillings. 4. Any person who may be desirous of obtaining a license for a slaughter-house (not being the renewal of a previously existing license) shall post or deliver to the Clerk an application in writing in the form of the first Schedule hereto and shall also give notice of the same as required by the said Act.
5. Every such application shall be considered by the Council as soon as conveniently may be after the receipt of the same by the Clerk and the Council may grant, refuse or adjourn the consideration of such application. Notice in writing of the date of the meeting at which such application shall be considered and of every adjournment thereof shall be delivered or posted by the Clerk to the applicant who shall have the right to attend and be heard in support of such application. 6. Every application for the renewal of any license shall be in the form of the Second Schedule hereto and shall be delivered to the Clerk on or before the first day of December during the currency of the license in respect of which such renewal is sought. The same fee shall be paid on renewal as for a new license. 7. Every person to whom a license for any slaughterhouse has been or hereafter shall be granted under the said Act by this Council shall (1) Provide such slaughterhouse or cause the same to be provided at all times with a sufficient supply of fresh water. (2) Properly feed and water or cause to be properly fed and watered at least once in every twenty four hours all cattle confined in such slaughterhouse or in any premises or inclosure connected therewith. (3) Keep such slaughterhouse and its appurtenances clean and in all respects in a state of order and cleanliness to the satisfaction ox' the Inspector. (4) Remove all filth, refuse, blood, offal, and other offensive matter from such slaughterhouse or cause the same to be removed therefrom at least once in every twenty four hours. . (5) Do or cause to be done within such time as the Inspector may appoint, all acts and things for the cleaning, purification, and keeping clean of such slaughterhouse and for theprevention or removal of any nuisance likely to arise or actually arising therefrom, .that the Inspector may require or direct to be done. (6) Obey the reasonable o rders of the Inspector. Anv person failing or refusing to do or cause to Ire done any act or thing- hereinbefore required to be done shall be guilty of a breach of this By-law and on conviction shall -forfeit and pay such sum not exceeding Five Pounds as the convicting Justices shall think fit. S. All persons employed in .or about any slaughterhouse'shall obey the reasonable orders of the Inspector. 9. The Inspector may forbid the slaughtering gf any animal which from poWty. ag<> or disease may appear to him to be unfit for the food of man and _ there after so such animal shall be slaughtered in any slaugh tec-house.
10. The fee which the Inspector may ask demand and receive under Section 34 of the said Act shall be one halfpenny for each and every head of small cattle and threepence for each and every head of large cattle slaughtered at any slaughter-house and for every such sldn inspected by him under the authority of the said Act. 11. Any person (1) Who being employed in or about any slaughter house shall fail or refuse to obey the reasonable orders of the Inspector. (2) Who shall slaughter or cause, permit, suffer, or procure to lie slaughtered in any slaughter-house any animal the slaughtering of which shall have been forbidden by the Inspector. (o). Who being the person to whom a license for any slaughter-house shall have been granted shall cause or allow, permit or suffer any nuisance to be created thereby or to arise therefrom or by or from any filth, refuse, blood, offal, or other thing removed therefrom shall be guilty of a breach of this By-law and upon conviction shall forfeit and pay such sum not exceeding Eive Pounds as the convicting Justiees shall think fit. FIRST SCHEDULE. I, of being owner (or occupier) of premises situate at within Hobson County do hereby apply for a license authorising me to use the said premises as a slaughter-house and to slaughter large and small cattle thereat. Dated at this day of 189 To the Clerk of the Hobson County Council. Applicant. SECOND SCHEDULE.. I, of being the holder of a License for Slaughtering, issued on the day of 189 with respect to j remises situate at of which I am owner (occupier) d© hereby apply for a renewal of my said License.
