Some of the Magistrates of the Dominion go just a little '' over the odds" theii deliverances from 'the bench. For instance, Mr. V. G. Day, S.M., ai Christchurch last week, is reported tc have i described th© Babbit Nuisanct Act as "a' reversion to the days oi barbarism." This expression was the result , of. a decision dismissing an information having been reversed, the Judge Holding that under the Statute the opinion of the Inspector as to what steps were taken for the eradicatior. of rabbits was final and conclusive proof/ Mr. Day has probably had nc experience whatever in rabbit-infested districts. He apparently knows noth ing of the difficulties experienced bj inspectors,iri inducing indolent settlert to do their duty. It is the duty oi ,the Magistrate to administer the law as ho finds it, and to describe a recent enactment as "a reversion to the dayi of barbarism" is to cast a xeproacl upon jho Legislature which is entirety improper and uncalled for.
