THE DEFENCE ACT.

AN ALLEGED BREACH

Before Mr L. G. Reid, S.M., in the Magistrate's Court at Masterton yesterday, Francis Owen O'Connor was charged with having failed to take the oath of allegiance, and with having failed to render the personal service required of Jiim under the Defence Act. This case had been adjourned from the last sitting of the Court in order to allow of an affidavit in connection with enrolment by defendant being obtained from .Ashburton.

Sergeant Miller stated that tho affidavit had. net yet been received. *. Mr Re id said that this affidavit would require to b'-> produced beforo the case could be continued.

Mr Moran, who appeared for defendant, said that this was the third occasion on which his client had been beforo the Court on the charges, and it was hardly fair to take him from his work again to-day when the authorities know that the affidavit had not Arrived. He applied for expenses for defendant.

Sergeant Miller stated that they had expected the arrival of the affidavit by every mail. Mr Reicl stated that defendant should have been informed that the affidavit had not arrived before the Court pat. fie allowed defendant 4s expenses for the time he h-id been fr-.ir.i work that day.
