In the course of evidence Thomas Walker referred to damages which
had been done to his land, which was leased to defendant, a plantation, being -practically destroyed, ('rains n-it properly cleaned out, while firewood had been taken off the property. \ Several witnesses gavo evidence that in their opinion, the property had not been properly attended to, clio drains not having been cleaned out, the fences not being kept in repair, and that a plantation had been destroyed. that he had been in possession of the. property four years, and the lease had another year to run. When the lease of the land had been obtained at auction it was announced that the purchaser would ho allowed £lO to put tlhe fences in repair. The fences were not- in good order when he entered into possesion, but he had kept the fences in repair since, and they were now in good order. He had the drains cleaned every year, and they were in first-class order. Ho had only taken six or seven cords of firewood off the property. In delivering judgment His Honor said that, there had not been any serious breaches of covenants, the. in jury to the plantation heing the most serious matter. The case could have boon settled by the Magistrates Court. He would refuse to cancel the lease, and would give judgment for -£2o"damages, as that would cover everything.
