COURT MARTIALLY

GORE, Last Night. The hearing of the court martial commenced on Friday was resumed today. Sergeant-Major-Instructor Horace Sutton, of the Now Zealand Permanent Staff, a soldier of the New Zealand defence forces, was charged with conduct to the prejudice of good order and military discipline, in that ho, in the Defence office at Gore, on Tuesday, July 30th, in the hearing of Quartermaster-Sergeant . Graham, when ordered by Captain Glendiniug to proceed to Balfour and make that place his headquarters as from August'lst, replied: "1 refuse to do so." or words to that effect.
Captain Hickey, D.5.0., appeared for the prosecutor, and Mr Cochrane as counsel for the accused.
Captain Hickey was asked to give evidence as to the accused's characcer.
Mr Cochrane objected, stating that the case for the prosecution had been closed.
This was overruled, and the witness read a statement detailing the date on which accused had been sworn in, and that he had not been previously convicted. There were no entries on the conduct sheet against him. tie was entitled to the pay of sergeantmajor.
Cross-examined witness said that he did not know anything of Sutton's record in the Imperial Army. The court subsequently considered its verdict, which will be submitted to headquarters before it is made public. In the meantime Sergeant-Major Sutton is still under open arrest.
