In the Singer Sowing Machine Company's case, the- assistant Manager gave evidence that he and the cashier knew of Brown's overdraft amount, and the period which it covered was disclosed in the books. Brown had absolute power, and Macnherson had to take his instructions from him. Witness knew nothing of how Brown's overdraft had been wiped off, till he received M-acpherson's confession, which led to the present proceedings. There iva.? nothing to show that Macpherson had acted wrongly, or in concert with anyone else. Witness had .stated that he had.wired to Brown, who was then in India, that Macpherson had .made a {.'onfcfision, and then absconded, and asking for instructions. Brown replied that he should use his own judgment, and be guided by circumstances. Amongst the- evidence was a tatter from Brown to witness, asking him to destroy old cash books and letters, in view of the norsihility of a checker coming from Now York.
