CLAIM RESPECTING A HORSE.
At itliei S.M. Court at Master ton yesterday, before Mr L. Kei'd, S.M., -Herbert Cole, of Ma.sr.ertoii, labourer, sued Richard Coupon, of ißidcford, farmer, for the • urn of £'2o, toeing £ls value of a horse of piaim(tdff'is, a\\liicOi dlied while hi defendant's custody, and £5 dktoagob for llrj&s of .the use of the said horse.
Mir C. A. Pownall appeared lor plaintiff, and Mil" G. H. Cullein for defendant. Plaintiff stated, that lie lent the BKir.se to defendant to ride to Homcwood, on condition that the defendant ibrougjlit .back another horse iro r a Homiewood whidh plaintiff had Brazing out there. The horse lost was over-fludiden by defendant, and as a consequence had dated. Tlhe plaintiff caMled George Brown, of Bomewood, fairm. employe, and Wlilliliiam Brown, of Ftefrtngleii, farrier, in support of his' statements. Defendant, iiv evidence, denied that die had .ovcir-ridden tlhe horse, and ,gaid that oil; the contrary he had walked tihe horse imost of the way, taking ton /hours on the journey from
iMastei'ton to 'FerngJen.. He said tlbat .tihe lior.se had saiceuimbed to a isevere attack of gripes, to cure iwihidh lie took every possible means 'available at isuah an out-of-.t'lie-way Jlocailiiity. Mr Pownalll, niftier fearing defendant's evidence, elected to take a snoiiISHllt.
His .Worshlip duly entered a mon.siiiit, and allowed defendant £2 2s counsel',si fee and 8s Court costs.
