BREACH OF CONTRACT
-.■■.- IN CONNECTION WITH RABBIT DESTRUCTION. <ln the Magistrate's Court 'at Masterday, before Mr L. G. Bieid, S.M., Roger 'Lartfan .Vennell and E. .■:. V, Vennell d'aimed from Donald Douglas a sum of £55 12s, being damages in connection alleged breach of contract. ' -~' .* ' Mr 6. H. Cullen appeared for plaintiff, and Mr C. A. PWvmiall for defendant. (E. V. Yeimell stated that he and Iris brother had a .contract) from defendant to kill 2500 rabbits in six weeks,, at the.i-ate of 3jd per head, th<> plaintiffs .being, allowed to retain the skins.. No mention- was> made in the contract as- to how. the rabbits <were to be killed. Plaintiffs used pea riffles. They worked (for about ten day® in a month, the remaining dayp being wet. Defendant' terminated, the contract, stating that it ■wto' too' expensive. PlaintiflPs intended .putttog on two men, and •would have completed the 'contract wiibhin the time. ' ■ * OR.. L. Vennell gave corroborative evidence. Witness also stated that ha sustained an - accident, and ■ defendant had refused to give him any compensation', advising witness to take the matter to court. This conduced the case for the plaintiffs. The defendant, in his evidence, maintained that E. V. .Vennell concluded the contract himself. He had been complaining all the time that the work was not paying them. Witness denied having terminated the •contract. His Worship said that from the evidence he was satisfied that defendant terminated the contract.
