(Before His Honor, Sir Robert J Chief Justice.) CUSTODY OF CHILDREN. Herbert Marton Wilton, of Masterton v. Rosina Elizabeth. Wilton, of Masterton, petition for custody oi children. ' Mr H. O'Leary appeared for petitioner, and Mr C. -A. Pownall for respondent. , Mr O'Leary asked for the custody of ' the two children. J Mr Pownall said the father had the ! custody of one child. The mother had had the custody of the little girl, ni-ie years of age. She was engaged in domestic service. The grandmother was a person of means, and had the git I for two years and 4 months. Mr O'Leary isaid the father had a good home, was earning good money, and was quite able to care for both children. Mrs Harding, mother of respondent, said Wilton and wife were separated in lglO, and they each took one child by agreement, in writing. Her father had never visited the girl since. • Cross-examined: My husband has been ill for 18 months. .Cannot say how much he has earned for three months. The grandmother could look' after the child; and the father have access to it. ■' There was no suggestion that the girl was not looked after. The mother can see the other child, and each visit could be mode fortnightly. The case was adjourned accordingly. A decree absolute was made in the divorce case.
