CARTERTON NEWS

(Own Correspondent.)

In the Magiisirate's- Court beforo Mr- L. G. Reid, S.M., a Carrington farmer named Griggs sued another farmer named O'Callinan of the same settlement for £2O damages, due to the result of a trap accident, allegedly through the carelessness' of defendant's son. The evidence showed that defendant's son was returning from delivering milk to the Belvedere Factory on Sunday, April 2nd, when a disagreement arose between young O'Callinan and another young man named Nimot. They got out of their carts to settle the dispute,, and during the temporary absence from the vehicle O'CaJlinan's horse set off for home, resulting in Grigg's cart, wihich was coming in the opposite direction, being upset, and the driver som-Qwhat injured. The defence asked for a nonsaiit, pointing out that the claim was against the father, while the son was 26 years of age, and his temporary absence from the vehicle to- settle a dispute was not part of his employment, but a deviation from it, and one over which, the master had no control. Several cases dealing with master and servant were quoted, and His Worship reserved his decision. Mr J. J. Mead appeared for plaintiff, and Mr C. A. Pownall for defendant. The second annual ball of the local Oddfellows' Lodge was held la«t night, and proved a very enjoyable function.

The milk suppliers of the Belvedere Co-operative Dairy Factory have arranged to hold a social gathering in the schoolroom on Wednesday evening nest. At the Magistrate's Court yesterday, Joseph McKnight was charged with failing to close his billiard saloon at the regulation hour (11 p.m.) Mr Hart appeared for defendant, and pleaded not guilty. The evidence of the police showed thaife the place was open at 11.25 p.m. ? but there was only one light burning'out-of eight, and the cloths were over the tables, no play going on.. , Counsel for defendant submitted that the evidence showed thait the place was practically closed. His Worship held that a technical breach had been committed on defendant's admisision. A. conviction was therefore recorded without penalty. Three young men, who were found in tho room were also convicted without penalty.
