LIBEL ACTION SETTLED.
OHRISTCHURCH, Last Night. A settlement has* been arrived at in the..libel action L. M. Isitt v. J. M. Stewart. The jury awarded Mr Isitt £SOO damages-, subject to the decision of his Honour the Judge, on a question of law, raised by the defence. It was pleaded that the publication of Mr Isitt's name in the trade Ist of the Trades Protection was. a privileged one, and that members of the Association were entitled to acquaint one another with the names of persons who were entered in the list and circulated amongst its members."" The Judge reserved his decision on. the question of privilege, and no damages would have had to be paid by the defendant to plaintiff until the Judge had 4 , delivered hi& Cl decision on that point * in the plaintiff's favour. In the meantime, the member of the Association who gave Mr Isitt's name for insertion in the trade"list arranged with Mi- Isitt to pay him £10 ? and both his and defendant's costsi in consideration of Mi-" ' Bait's" abandoning any verdict which . he might obtain, against Mr Stewart, and also refraining from taking any proceedings against the said member. This course Mi- Isitt has" agreed to, a-s he had brought the action for the purpose of clearing his character and credit, and "not for the purpose of obtaining heavy damages. The matter will therefore be settled on these terms.
