A HORSE TRANSACTION.
AN INTERESTING CASE, In a case recently heard in the Magistrate'® CW.fc at Masterton, an order was made against John Culloty for the return of the mare "Wild Rosse" to Thomas Carroll, of Mauriceville. As this order had not beeai complied with, further proceedings were taken in the Magistrate's Court yesterday. Mr P. L. Boilings appeared for plaintiff, and Mr G. H. Cullen for defendant. . Mr Boilings briefly outlined the facto of the'previous case, and stated that plaintiff had called for the mare and that, defendant, instead of returning her, had blackened -the former's eyes. Plaintiff then sent, another man, who wa,s ordered .away. Following this the bailiff waa. sent with -a warrant, but the animal was not to Ibe found. An order for the return was therefore asked for. ' Mr Cullen stated that the -mare had simply been spirited away, and the defendant could find no trace of her. The paddock gate had been left open, and the other horse;/ had .been found straying on the road. Counsel suggested that this ih'«d been done by some maliciously disposed i person. He asked that the evidence i of defendant lie taken.
His Worship stated that it was not a question of evidence, but of facts as admitted by wransel on both sides He was quite satisfied that the mare had not been delivered, and; that defendant , had (throughout displayed considerable unwillingness to gave her up. The order had not been obeyed, and His Worship was not satisfied that the animal had escaped accidentally. An order would be made for the return of the mare within seven days.
