AN UNUSUAL CASE.
HUTCHISON v. PUBLIC TRUSTEE. .

An unusual case was before Mr Justice Cooper to-day. The original r.ction was brought by Mabel Carrington Hutchison, one of the daughters of the late Win. Booth, of Carterton, against the Public Trustee, executor, to have the accounts taken on the basis of allegations of negligence against the Public Trustee, particularly in the sawmilling business.
-The Judge held that the losses were mainly through circumstance:; over which defendant had 110 control. failed to establish any breach by the defendant.
To-day the defendant moved for judgment with costs as between his solicitor and client, Petherick, who received judgment for plaintiff. Though Mr. Geo. Hutchison was solicitor at the hearing he consented to the action being dismissed, but resisted an application regarding •costs.
The action was dismissed with costs as between part-v and party. The Judge said plaintiff had brought th" action upon her solicitor's advice, which ho did not doubt was honestly given, although in his view it was erroneous.
