[By Telearavh —Press Association.]

WELLINGTON, Last Night. «'

Another phase of the well-known Mewhinney case was before the Magistrate's Court to-day, when Oliver Mewhinney and Jeremiah Stevenson were charged with breaking, entering, and theft at the dwelling of Nettie Mewhinney at Seatoiin, where the cpmplainant had been living since divorce proceedings about May, 1909. It was alleged that the defendants broke into the house and took a number of household articles. Mi'. Wilford, who appeared for the "defence, said he would prove that "Mrs Mewhinney's story was a concoction. After hearing evidence, the Magistrate said lie did not think a jury would convict Stevenson on the evidence produced. The charge against him was therefore dismissed. Tne case against Mewhinney will be further proceeded with to-morrow.
