BOOKMAKERS APPEAL DISMISSED.
; • 'NAPIER,. Last -Night-. ■ /■ At the Supreme Court to-day, the Chief Justice gave his decision in the appeal case Fitzpatrick against the police. In the lower Court the appellant, a bookmaker, was of betting with an infant and fined £75, and lie now appealed on the : ground- that the youth appeared to be over 21, and! that as soon, as Fitzpatrick learned from; tie* policeman that he was under li© returned the money and declared the bet off. The evidence showed that the youth had been a. frecj-nenter of racecourses, and though only 20, might have been mistaken for 21 or over. His Honour dismissed tlie> appeal, holding that the onius of pl-oof of the youth beii% apparently over 21 was on appelant, which onus had not been discharged, andl he refused tlie mitigation of the fine, adding, however, _ that appellant might apply to the Crown authorities for a. remission of the . fine, which certainly seemed. heavy. Th e conviotioni would be upheld, with costs against th© appellant.
