A MASTERTON APPEAL.

CORDON v. BUT7REY. (By Telegraph—Press Association.) WELLING TON, Friday. Mr Justice Cooper gave judgment to-day in the case 1 Gordon v. Buttrev, an appeal from the decision of Mr W. It. Haselden, S.M., while sitting in Masterton as a. District Court Judge in March, 1909. Buttroy sought £2OO damages from Gordon for alleged wrongful arrest, and the jury awarded him £SO. The appeal was on points of law. To-day the. Court held that there was no evidence to go to the jury; that appellant (Gordon) had by any misconduct on his part obtained the warrant for Buttrey's arrest, and therefore tho case should not have been left to the jury, as there was no material to bo submitted to them upon which they could find a verdict for respondent. Tho appeal was allowed, and" tho judgment of the District Court set asi-Jo.
