PAWELKA COMMITTED ON CHARGE OF MURDER.

SERGEANT MAGUIRE S DEATH.

Towards the conclusion uf the trial of Pawelka upon a charge of having murdered Sergeant Maguire, Detective Gallagher stated that after he arrested the accused in. a loft at Ashhurst, Pawelka tripped witness, and said to him, "Do you think I'm a coward? If so, take these (the handcuffs) off, and I'll show ,you." Witness said. "It's all right, Joe; you would not shoot me." Thompson said, <'Who shot poor Maguire?" to which the accused replied, "Who fired the first shot, you ?'-

Pawelka called out, "Liar!" from the dock. He then rose, and said, more calmly, "Your Worship, he's a liar."

Proceeding, the witness stated that among the articles be found in the possession cf the accused were cartridges, detonators, money (three halfpennies, ninety pennies, and eighteen threepenny pieces), a copy of the Manawatu Standard of April 16tn, a pocket knife, and a cap. Constable James Thompson, of Wanganui, also gave evidence of the capture. Gallagher said to Pawelka, "You would not shoot me, would you, Joe?" Accused made no reply. Witness then said to him, 'Who shot poor Maguire?" Accused turned to him and said, "Who fired the first shot, you ?" He was spent and very low at the time, and they had to listen pretty well to''hear what he said. Detective Cassells gave evidence that in company with Detective Siddells he saw the accused in the cell at Palmerston, and accused him of the murder of Police Sergeant Maguire on April 10th by shooting him with a revolver at Mr Hampton's house, Ferguson Street. Accused made no reply to the charge. The accused was committed to stand his trial at the next sitting of the Supreme Court in Paliuerston North. He was then taken to Wellington by the afternoon train.
