MAGISTRATE'S COURT.
MASTERTON—THURSDAY. Before Mr C. C. Graham, A.M. Judcraent for plaintiff by default was delivered in the following cases: —Alpass and Co. v. William Dodd, claim £3 15s. Judgment was given for £3 5s 6d, costs ss; W.F.C.A. v. Allen King, claim £5 4s Id, costs 15s; Mauriceville Co-operative Store Co. v. Neils C. K. Schow, claim £3l 15s, costs £1 7s. An order was made for payment m the following Judgment summonses:—Martin U. Olds v. Martin Carr, claim £3 3a. Order made for payment forthwith of £1 sa, in default three days' imprisonment. and Cook v. Frank Reeves, claim £2 3s lid. Order for payment of amount claimed forthwith, in default seven days imprisonment. Tbe warrant was, however, suspended for one month.
Emily " Carrol (Mr Pownall) sued Arthur Perish (Mr Pragnell) for £35, the price of seven cows. Afcer hearing evidence, his Worship gave judgment for the amount claimed, with costs £5 4s Bd.
The adjourned case Hayes v. Fraser and White, a partnership claim had just commenced when it was suggested that an amicable settlement might be arrived at out of court. His Worship adjourned the court for' fifteen minutes and the dispute was then declared settled out of court.
John J. Tumor (Mr Pownall) claimed the sum of £9 from Messrs H. Cole and Son (Mr Pragnell) for wages due at £3 per week. The defendants put in a counter claim of £8 18s. Tumor had been a waggoner for Mesrss Cole and Son engaged in carting timber from Mr T. Rathbone's mill at the Admiral Run to Gladstone. Evidence in thq first case was given by H. Cole D. Cola G. Watson and J. J. Tumor and i-i the counter claim by 0. TunnkLffe, H. Cole and J. J. Turnor.
After bearing lengthy evidence his Worship said this was one of those disagreeable cases where one must be guided by corroborated evidence, and the probability of the case. The counter claim against Turnor for £8 18s would be dismissed, and judgment would be given for the plaintiff for the full amount claimed (£9) with costs amounting to £4 Is 6d. In the defended case Beale and Parton (Mr Pragnell) v. Mrs Howell (Mr Pownall), claim £2 17s 3d, judgment was given tor plaintiffs for £2 5s 6d, with costs amounting to £2 2s.
