MAURICEVILLE COUNT* COUNCIL. BY-LAW, 1909. riIHE Council of the County of Mauriceville hereby makes (by special JL order) the following by-law under and by virtue of ''The Counties Act, 1908," "The Public Works Act, 1908," and all other Acts and powers whatsoever enabling it in that behalt, such By law to come into force on I Thirtieth day of September, 1909. ( m 2. In this By-law except where inconsistent with the context "County means the Mauriceville County. "Clerk" means the Clerk for the time being of the County. "^ "Road" means and includes every road, bridge, ferry or ford which is or shall be under the care contral. or management of the Council. ""Heavy Traffic" means' heavy traffic as denned by section 139 of "The Public Works Act. 1908." 3. Every person guilty of an offence against or committing a breach of or failing to perform any duty imposed on him by this By-law shall be liable for each offence, breach or failure, to such penalty not exceeding £5," as the Court inflicting the same shall in its discretion think fit. 4. Part IV. and section 37 of Part 111. of "The Mauriceville County By-law, 1902," are hereby repealed. 5. It shall be an offence for any person to cause, or permit, or to be knowingly concerned in causing or permuting any vehicle or machine to be engaged in heavy traffic where timber (whether split, sawn or in logs and not being firewood), or wool, or bricks, or flax is or are being transported either separately or together with any other thing or things upon any road unless such vehicle or machine shall have been duly licensed under this By-law. This Bylaw may be cited or referred tofas "The Mauriceville County By-law, 1909," and shall apply to the whole of the County of Mauriceville. ?T"*fi. The license fee payable under aection 5 shall be £25 a year, provided, however, that in the case of a traction engine engaging in such heavy traffic as is mentioned in- section 5. and which is licensed under Part'lll. of "The Mauriceville County By-iaw, 1902," a yearly license fee of £2O shall be charged in lieu of the said fee of £25 and the existing license shall be handed into the Clerk and forthwith cancelled and upon the said license fee of £2O being paid to the Clerk and such exist ■ ing license being cancelled, a license shall be granted as hereinafter provided. Provided, further, that when a license has been obtained for a traction engine under this by-law, such traction" engine shall while such license is in force be deemed to be also licensed under the said, Part 111. 7. Every license under this By-law ohall be applied for in writing, under the hand of the person making the same, addressed to the Clerk. Such application shall set forth: — The name and address of the applicant. (2) The weight andadescription of the vehicle or machine in respect of which a license is applied for. (3) And in respect of traction engines the particulars set forth in section 11 of the said Part 111. 8. For the purpose of satisfying himself of the truth of the matters contained in such application the Clerkjjmay cause such vehicle or machine to be examined by an engineer or other competent person. 9. Upon being satisfied of tha truth of the matters contained in such application, and upon payment of the prescribed license fee, the Clerk sh,all forthwith issue a license under his hand in, the form in the First Schedule hereto, or to the like effect, to continue in force for one year from the date thereof. 10 Any person authorised in that behalf by the Council may stop and j detain any vehicle or machine which in his opinion infringes this By-law until the weigh of such vehicle or machine and the load thereon or the weight or measurement of the contents thereof can be ascertained, and the person in charge of such vehicle or machine shall permit the same to be stopped and detained accordingly. 11. No person shall drive or conduct any vehicle or machine which shall be engaged in heavy traffic upon any road unless the correct weight of such vehicle or machine shall be legibly painted upon a conspicuous part therpof. 12. The weight of the contents of any vehicle or machine shall st far as regards any goods mentioned in the Second Schedule hereto be computed according to the scale set out in such Schedule. 13. "Rough timber" in the Second Schedule means timber not exceeding 9 feet in length and haying a girth not exceading in any part 36 inches that has not been wholly or partially sawn, dressed, squared or shaped, (other than by splitting) except across the ends thereof. 14. In computing the weight of a load or quantity of "rough timber" (as hereinbefore defi(iyd) for the purposes hereof the measurement shall be taken in thejnanner commonly.adopted for the measurement of a stack or quantity of yplit firewood or other similar irregular timber, to wit, by ascertaining the cjbi.:al measurement of such load or quantity as a whole, and such cubical measurement so ascertained shall be deemed to be the cubical measurement of the timber. 15. Section 18 of "The Mauriceville County By-law, 1902" is hereby repealed 16. Every person who Is about to conduct over any road any vehicle or machine engaged in heavy traffic shall, before so do4ng. give security to the Council that no special damage will accrue to any read by reason of the heavy traffic in which such vehicle or machine is about to be engaged. The amount and nature of the security shall be such as are agreed upon be ; tween the said person and the County Council, or (if no agreement is made) such as are reasonable, having regard to all the circumstances of the case. 17. It shall not be lawful for any person to cause or permic any vehicle or machine to be engaged in heavy traffic during the months of May,"June, July, August and September in any year on any road except the Opaki-Manawatu Main Road, and no license issued under this or any other By> law of the Council shall be deemed to authorise heavy traffic except as aforesaid during any of the said months. FIRST SCHEDULE. This is to certify that having applied for a license under "The Mauriceville County By-law, 1909," in respect of the (vehicle or machine) hereunder described, such (vehicle or machine) is hereby licensed to engage in heavy traffic of the description mentioned in section 5 of the said By-law for one year from the date hereof. Description: Date: County Clerk. SECOND SCHEDULE. '4l g cubic feet of any timber other than rough timber shall be deemed to weigh one ton. 85 cubic feet of rough timber shall be deemed to weigh one ton. 114 cubic feet of wool shall be deemed to weigh one ton. 24£ cubic feet of bricks shall be deemed to weigh one ton. i 140 cubic feet of flax shall be deemed to weigh one ton, THE COMMON SEAL of the Chairman.
