A POINT THAT FAILED.
A point of some interest to business men cropped up in the Wellington Supreme Court the other day. A petition was lodged by the brash Food and Ice Company, for the adjudication as a bankrupt of a certain vendor of milk. The petition was opposed on the ground that there was not an existing debt of £3O due to tne company, the reason being that the debtor had paid info the Magistrate's Court, in part satisfaction of the judgment, a sum which reduced the amount of h's indebtedness to less than £3O : His Honor held that the creditor was not bound to accept that a7nount, and that therefore the full debt was sflll existing, and consequently made an order for tha adjudication of the debtor as a bankrupt in accordance with the motion.
