RACING APPEALS.

By Telegraph - Press jr. 1 _ NAPIER, May 7. ""Sir George Clifford and Messrs George Hunter and J. W. Abbott, the judges appointed by the Racing Conference, have had two appeals before them. They have remitted the Cunningham case to the Auckland Metropolitan Committee for consideration of the fresh evideme which had not been produced at the previous bearing by them. In the Royal Soult case the judges' decision is as follows:—"In tie* matter of the appeal by Samuel Gtoi Lindsay, owner of the horse Royal Soult, and Mark " Ryan,. jockey* against the decisions of the Aucklard Metropolitan Committee endorsirp' the disqualifications imposed by !.'.e Avondale Jockey Club, the .yj&jez are of opinion that the horse Ro,vt,i Soult was with the knowledge an.; consent of the owner, Samuel Geo. Lindsay, fraudulently previotr-d from winning the Nihotapu Handlcap, run on the second day of thi Avondale Jockey Club's sprnur meeting in. 1908. The evident :.. not decisive as to whether he- was so prevented by an over-feed ajiv.i.v istered by one, Wm. June?, ;.i alleged by him or by|being deliberately pulled by the jocKey. Mark Ryan, though many circumstance seem to Indicate that! tha confession of Wm. Jones was conclusive. The judges feel compell'sd l .r give Mark Ryan the benefit vt tht their doubt as to the method adopted in stopping the horse. They tr>e> ?- fore confirm the endorsement by the Auckland Metropolitan Commitic: of the disqualifications by the Avondale Jockey Cldb of Samuel George Lindsay and th» horse Royal Soult for two years, but reverse the decision of the said Club as regards the disqualification of the jockey Mark Ryan. They call the attention of the Auckland Metropolitan Committee to the evidence given in,this case by Wm. Jones, and recommend that he be disqualified for life. They order the deposits of the appellants to be refunded.'''
