THE THAW CASE.
Another chance for liberty was given to Harry K. Thaw recently by Justice Thompkina in the New York Supreme Court, says the New York "Herald," when he decided that Thaw was entKled to a trial by jury .to determine his sanity. Thaw was brought down to New York from Matteawan on a writ of habeas corpus, obtained by his mother, who said in her petition that he "has not been committed, and is not detained by the virtue of a mandate issued by a Court or a judge of the United States, or by virtue of the final judgment of the Court."' The fight now will be on where to hold the trial. District-Attorney Jerome and Colonel Asa Bird Gardiner want it held in New York. Mr Morschauser, Thaw's counsel, wishes the trial in either Rockland or Dutchess '. The District Attorney o'' New York County has'mi.-vcd that the case be taken into his county; that is the question immediately,before this Court. I shall decide it justly. The other questions deal with Thaw's sanity." Mr Jerome told the Court that mod' r scientific opinion held that 'i Law v. e:;an incurable paranoiac, and too dangerous a person to be at large. Mr Morschauser did not want Thaw remanded to Matteawan, whichfJustice Tompkins had ordered. He said that at the asylum he could see Thaw only at certain prescribed hours in a room where he had only the floor as a desk. The Court directed that counsel could see Thaw at any hour in a private 'room if he wished. Mr Gardiner then remarked that Mr Morschauser was taking his own risK of being brained by Thaw. Justice Tompkins said he would give especial attention to the request f< v a charge of venue. If he sen;s the trial to New York County, he says he will leave it to the justice there to dttermine the method of trial.
