H> ' —' BY TELESRAPH —PBKSS ASSOCIATION., PALMERSTON N., September 14. The case of Elizabeth Dunstall, of Dannevirke, v. Edward Perry, occulist, of Palmeraton North, a claim for £I,OOO damages • for alleged wrongful treatment and injury to the right eye, was held before Mr Justice Chapman to day. Mr W. L. Fitzherbert appeared for the plaintiff, and Mr T, Wilford for the defendant. The case extended for twelve hours, and a large amount of evidence was taken. Plaintiff claimed that she had suffered permanent injury to the eye through defendant having treated her uy massage, and a I.so by the use of atropine. Evidence for the plaintiff was given by Dr Reid Maokay and Dr Martin. For the defence it was denied that massage had been applied. Drs Borghetti and O'Brien gave evidence, the former insisting, in face of ottiei" medical evidence, that plaintiff's trouble was ''ue not to rneumatism, but to a malignant disease. Two witnesses deposed that plaintiff had told them that Dr Martin had urged her to take action against Perry, and argeed tj baoK her. His Honor summed up in favour of the defence, and the jury returned a verdict for the defendant. Costs were allowed accruing to scale, with disbursements and witnesses ex penses.
