BREACH OF TAILORS' AWARD.

BY TSI.SOrtAP.I—PB-?SS ASSOCIATION. WELLINGTON, September 2. What was described by Mr Le Cren, Inspector of Awards, as a serious cate of a breach of the tailors' award, was heard by His Honor Mr Justice Sim and Messrs S. Brown and J. A. McCu I mgh in the. Arbitration Court to-day. Clause 7 in tho award provides that all besp.'ke work shall be done in the shop of the employer for whom the same is performed, and for whom or by whom the order is taken. Proceedings were taken against Glass and Lewis, tailors, by the Department on the ground that they had committed a breach of this clause in taking orders from various persons between June and December last year, and having the garments made up in a > factory contrary to the award. M; Levy, on behalf of the respon lent Lewis, stated that the partnership had been dissolved'between the two parties. A breach of the award was admitted, but Mr Glass was the partner really responsible, as Mr Lewis was always outside travelling to obtain orders. He would ask the Court for leniency, as Mr Lewis was innocent in the matter. Mr La Cren described the shop run by the respondents in Taranaki Street in the latter half of 1907 as a mere blind. No work was done there. Orders were taken for suits, but all clothes were made in the factory. In six months .£l7O 14s 3d had been piid t) the factory for the make up of garments which were sold as tailormade. They were taken from the factory in an unfinished condition for a "try on" and then returned marked for alteration. He considered MiLewis must have had some knowledge of the proceedings. The Court held that it was impossible from the statement of fact made by the lnspec f or 11 believe that a breach ha i beat", committed without the knowledge of Mr Lewis. He must sutler for what his partner had done. A fine of iJS and would I be imposed.
