BY TKLF.OKAPII —IMIKS3 ASSOCIATION. THE ELLIOTT CASE. ACCUSED SENTENCED. WELLINGTON, May 25. Albert Clarence Elliott, the Wellington bankrupt who recently went lo Australia, returning and surrendering to the police at Auckland, was sentenced at the Supreme Court this evening to three years hard labour for fraud and theft upon each of four charges, the sentences to be concurrent. Before sentence was passed Mr Wilford for accused said Elliott was 32 years of age. He started business four years ago with a capital of £25. His first venture resulted in a loss of £IOO, necessitating borrowing money at a high rate of interest. Then he endorsed bills for others and got further into trouble. He had paid as much as £SO for the loan of £2OO for a month, £lO for £25 for six weeks, and £ls for £SO for two months. Then he started speculation, his health broke down, and he started on a career which landed him in the dock. Mr Wilford submitted that the prisoner was a sinner rather than a criminal. Mr Mjers, the Crown Prosecutor, pointed out that there was evidence of forgery, and the deficiency amounted to thousands of pounds. On a further charge, which Elliott contested, the jury found a verdict of not guilty. KILLED BY A TRAIN. AUCKLAND, May 25. A man, named J. O'Laughlin, while attempting to cross in front of the 5.25 p.m. train, to-night, at the road crossing near the Papakura station, was struck by the engine and killed, his skull and legs being fractured. FATAL COLLISION. A PLUMBER KILLED. AUCKLAND, May 25. A collision occurred near Penrose to-night, between an Onehungabound train and a railway jigger, on which were seated two men named Matthew Brennan, a platelayer, and James Barton. Barton was shockingly injured, and died within a few minutes. Brennan sustained sligh injuries to his head. Barton was a plumber residing near Onehunga, and he leaves a wife and five young children.
