THE PROPOSED WATER CHUTE.

SYNDICATE'S APPLICATION NOT

ENTERTAINED

A special meeting of the Masterton Borough Council was held on Tuesday afternoon last to consider the report of the Park Committee with reference to the application of a local syndicate to establish a water chute and other public amusements on the Park Lake. There were present—The Mayor (Mr J. M. Coradine), Crs J. H. Pauling, W. Morris, J. C. Ewington, J. Prentice and J. Yaw.

The Mayor read opinions from Mr T. Martin, solicitor to the Municipal Corporations Association, and Messrs Bunny and Dolan, who stated that tho Council could not legally give the exclusive use of any part of the Park to any person for a longer period than ten days in any one year. He, therefore, ruled that it was beyond the powers of the Council to deal with the application, and the Park Committee's recommendation, to favourably entertain the propr.sal, could not be adopted. _ ' ' Mr S. R. Gawith, who appeared, on bebalf of the syndicate, said the facts of the application had not been placed before Mr Martin, who had given a very wide opinion. He suggested that the facts should be allowed to be placed before the Council by the syndicate for the Council to forward them to the Association's solicitor for another opinion. The Mayor said he was satisfied that the full facts had been placed before Mr Martin, and he could not agree to Mr Gawith's proposals. Cr Ewington thought the Council should do what Mr Gawith suggested. The reason why he had caused the opinion of Messrs Bunny and Dolan to be sought in the matter was because he thought Mr Martin had not been furnished with a complete statement of the position. He was prepared to move in the direction of giving effect to Mr Gawith's suggestion. The Mayor: You can't. I have ruled against the application and the Council is done with the matter. The meeting then adjourned.
