WHEN IS A MAN DRUNK?

By Telegraph —Press Association. AUCKLAND, September 25. At the police 'court, yesterday afternoon, J. Patrick Sarsfield, alias Kelleher, was charged with disorderly conduct while drunk, and with committing a breach of his prohibition order. Accused was brought before the court about a week ago, when he said he was an escaped lunatic, and was remanded for medical treatment. A certificate had been given that the man was all right. The arresting constable gave evidence as to the circumstance* " sur _ rounding accused's arrest Accused: When i* a man drunk? Witness; When he cannot take care of himself. "Suppose a man went out in the street," said accused, "and shouted at the top of his ,voice and waved his arms about, would he be drunk?" Witness: Not necessarily." After further dialogue of this description, the magistrate fined Sarsfield £2 and costs, and on the charge of breaking his order £2 or one month's imprisonment. Accused said he was not satisfied with the definition given of drunkenness.
