- A TEST CASE. By Telegraph—Press Association DANNEVIRKE, August 13. At the last sitting of the S.M. Court the case of Fairhurst v. the Cyclopedia Company, an action to recover an amount paic! on the New Zealand Cyclopedia, was heard. The claim was based on the allegation that the cyclopedia was not of the character represented by the defendant's canvassers. Mr T. G. Russell, of Christchurch, for-the company, urged a nonsuit. In a lengthy judgment. this morning, Mr James, S.M., upheld counsel's contention. Twentyseven cases of a similar nature depended on the judgment.
