MASTERTON—FRIDAY. (Before His Honor .fudge Hasslden.) CLAIM FOR DAMAGES. The civil case in which T. Dwyer and Co. claimed from Ah Kin the sum of £167 19s 3d, for damages caused to plaintiff's motor car by a collision with defendant's cart, in High Street, on April oth, and in which Ah Kin lodged a counter claim for i!ls for damages caused to his dart, was concluded yesterday moi*ning. After counsel had addressed the jury his Honor summed up. He said the jury had four issues to decide, viz.—(l) Was the collision caused by negligence on the part of the defendant's driver in driving the cart at night without lights? (2) Was the plantiff guilty of contributory negligence? (3) What damage, if any, was the plaintiff entitled to? (4) Was the defendant entitled to any damages on the set-off or counter claim? His Honor stated that if the jury found for defendant on the first issue, then there was only the question of the counter claim to be considered, as the other issues did not come into consideration in that case. The jury retired for ten minutes, and then the foreman announced that their finding on the first issue (was the collision caused by negligence on the part of the defendant's driver in driving the cart without lights?) was, "No." Their answer to the fourth issue was also in the negative. His Honor accordingly gave judgment for defendant on the claim with costs. Mr Pownall asked leave to move for a new trial in the ordinary course. The application was granted. BANKRUPTCY BUSINESS. William Henry Williams was granted a discharge from bankruptcy. Mr Pownall applied for a discharge on behalf of Richard Joseph Hodgins. Mr Dolan (acting for the D.0.A.) stated that some negotiations were pending in reference to an interest bankrupt had in the Shamrock Hotel in Wellington. He asked that the granting of the discharge should be postponed. Mr Pownall opposed the adjournment. Hs Honor said that certain matters mentioned by the D.O.A. would militate against an immediate discharge. Ho granted an adjournment till the next sitting of the Court, and, unless some specific charge was then made against the bankrupt, a discharge would be granted. Mr Pownall applied for a discharge on behalf of A. R. Maltby. H f s Honor granted the application.
