BANKRUPTCY PETITION.

At the District Court, Mastertoc, yeßterday, Mr E. Rawson heard a petition for the adjudication aa bankrupt of G. 0. L. Jensen, late of Peatherston, and now of Risaiugton, Hawke'a Bay. Mr B. v J. Dolan (instructed by Mr J. W. Card, of Featberston) appeared for, the petitioning creditor, Mr E. H. Saunders, of Peatherston, storekeeper, and Mr 0. A. Pownall represented the debtor, Mr Dolan stated that the act of bankruptcy relied upon was. the contention that the debtor left Peatherston with the intention 'of delaying and defeating his creditors. He had gone to Hawke's Ha* in June last leaving no address, having incurred /debts to Peatherston acd Wellington creditors, totalling acme £2OO. He had been arrested about a fort-* night ago, Hud imprisoned at Nap'er, and was released upon giving surer ties to appear at Maaterton when called upon by the Court. Messrs E. H. Saunders and W. 0. Vincent gave evidence in support of counsel's statement. Mr Pownall contended that the petition was technically defective on the ground that it had been attested by "Edward Barton,Peatherston, farmer," and not by a solicitor or Justice of the Peace, and on iother grounds contended that it was a nullity. He also stated that there was bo intention on the debtor's part of delaying or defeating his' creditors, and that Jensen had left the district to go to some relatives 'at Hawke's Bay in the hope of securing certain cor.tracts there. Tfce debtor gave evidence in corroboration of this statement. He left Peatherston with only £5 and had tafceu no steps whatever to binder any. of hia creditors. - The Registrar stated that he would reserve his decision, Mr Pownall giving an undertaking in the meantime that the debtor would attend the Court, ou being given reasonable notice to that effect.
