MAGISTRATE'S COURT.
MASTERTON—THURSDAY. (Before Mr W. P. James, S.M.). Judgment for plaintiff by default with coats was given in eaoh of the following debt oases •.—Patrick Patton v. John Barley, claim 14b 6d, costs sa; Thomas Mills v. Mnx Joseph, claim £4 153, costs 10a; F. C. Lewis, as liquidator of Lowes and Irons, Ltd., v. Alfred Edward Watson, claim £l9 13s, ooats £2 2s 6d. In the judgment summons case of H. Remington v. tfre'd Baihley, a claim for £4 Is, defendant was ordered to pay forthwith in default seven days' imprisonment. The order was suspended for one month. On charges of drunkenness Samuel Koko, a native, was fined £l, and William Mahoney and Jas. Murphy were eaoh fined 10s. J'enkinaon and Co. claimed from Dr. McCarthy, of, Greytown, the sum of £35 being the difference between the prioes of an 8 h.p. motor oar, and a 10 h.p. motor oar. It was stated in evidence that defendant ordered an 8 h.p. car, but the oar sent out from England was a 10 h.p. The plaintiffs alleged that the defendant agreed ito pay the differenoo in the pride. The defendant alleged that he made no agreement to pay the extra amount. After hearing oonaiderable evidence tho Magistrate nonsuited the plaintiffs with ooats amounting to £3 ss. Mr D. K. Logan appeared for the plaintiff, ' and Mr 0. A. Pownall for the defendant. Leave to appeal •was granted.
