DUNEDIN S.M. COURT.

DUNEDIN, May 14. The adjourned case in which the Collector of Customs proseouted Ernest James Fenn, of Stewart and Fenn, electrical engineers, in respect to a declaration made as to dutiable goods, was continued, today, before Mr W. G. Widdowson, S.M., The firm had ordered an electrical plant from Brush and Co., and when the invoice and goods arrived the usual declaration was. made aa to the value; figurps of the invoice being accepted aa correct. Brush and Co. bad since sent a ! declaration that the dutiable goods, instead of being of the value of £6O, have been valued at £l6O, a mistake having been made by their clerk. y The goods' were in the meantime detained and confiscated. Evidence was given for the defence. Mr Fraßer, for the Crown, said that declarations were made byfimporters who had a special knowledge and were the only people who had that knowledge. A man who said, "I do not know," or "I never gave the matter thought," was guilty of fraudulently concocting a scheme , for defrauding the Customs. His Worship reserved his decision. On the information under Suction 243, the summons charging Fenn with being kuowingly concerned in a fraudulent evasion, was dismissed, no evidence being called on it.
