JUDGMENT FOR DEPENDANTS.

Hia Honor the Chief Justioe delivered his reserved judgment in the Supreme Court, Wellington, on Wednesday, in the case in whiob H. G. Balfour-Kinnear, of Palmerston North, sued the New Zealand Loan and Mercantile Agenoy Company, Ltd*, for £515, being in respect of an alleged guarantee entered into by the Company, through its agent, Frederiok Draper, of the aocount of George Kiohnrds, stookdealer, Masterton. The defendant Company relied upon the faots, alleging that Draper entered into no suoh undertaking; and, further, that as far as the law was concerned, the guarantee, if it did in fact exisi, should be in writing under the Statute of Frauds. The Company further alleged that plaintiff had already proceeded against Richards and that his election to so proceed ousted the Company's liability. The Objef Justioe gave judgment for defendant Company, with costs. Dr Findlay (instructed by Messrs Bald win and Baldwin, Falmerston North) represented plaintiff, and Mr Myers (instructed by Messrs Bunny and Dolan, solicitors, Matterton) appeared for defendant Company.
