RESIDENT MAGISTRATE'S COURT, LAWRENCE.
Monday, 21st September. (Before E. H. Carew, Esq., R.M.) Chin Que y. John Geeves. — Information charging the defendant with assault and battery. Mr. M'Coy for the plaintiff ; Mr. Henderson for the defendant. Mr. Henderson said that the information was bad, inasmuch as it stated that tha defendant " assaulted and beat," &c, and not " unlawfully assaulted and beat," &c, and that omission of the word " xmlawf ully " was fatal. Mr. M'Coy said that whether the assaulting was lawful or not was a matter of evidence. If the defendant could show that it was lawful, it would be a good defence. The information also showed that it was an unlawful assault that was complained of, as it was stated to be contrary to" the form of the statute in such case made and provided. His Worship upheld Mr. Henderson's objection. A new information was afterwards laid. Mr. Carejw stated that for some time to come the Warden's Court would sit on Monday, at 2 o'cleck, instead of on. Wednesday, as formerly.
