(Before E. H. Carew, E3q., R.M.) Tuesday, 2nd Jtjkb. Roberts t. Lancaster. — Claim of £21 16s. for trespass by sheep on the Spylaw run. Mr. MCoy for plaintiff ; Mr. Henderson for defendant. Not indobte 1 was pleaded, and a set-off for a larger amount, being for a cross trespass, was put in. His Woi-ship hell that the set-off could not- be allowed as the damages were unliquidated. John Cameron, the manager of the station, proredthat tho sheep, the subject of this crwe, were mustered on the 9th May lust, and tal:en away by Lancaster's man. Lancaster's sheep were more numerous than his land would carry, and bad been trespassing ever since he got them, about twelve months ago. The witness failed to show, however, that the sheep had been masstered on the run in the first instance. The case was dismissed, with 213. profesaional costs. - " Smith v. ITiUcliixon. — Claim of £5, for trespass with horses. The defendant did not appear. Tbe defendant, a carrier, had permitted his horses to trespass in the paddock of the plaintiff, doing damage to the amount of ss. a head. Judgment for 355.; costs of Court, 35. ; one witness, 2Gs. ; aud professional costs, 21s. King (as and being manager of the Beaumont and Tuapska Water Race Company, Registered) v. Jeffery. — Claim for £6 55., being the fourth aud fifth calls on 25 share?. Mr. M'Coy for the plaintiff ; Mr. Henderson for the defendant. Q-. B. King proved that ho was acting aS manager at the time proceedings were taken, and- produced the minute book of the compaTry,-Bhowing the resolutions by which the^alls were made. Mr. Armstrong proved that Mri Jeffery was a director^ and gave information about matters of which tbe last witness, having recently become connected with the company, had no knowledge. Mr. Henderson asked for an adjournment to Friday next, which was granted on payment of costs, and professional costs 21s.
