RESIDENT MAGISTRATE'S COURT, LAWRENCE.
(Before E. H. Carew, Esq., R.M.) Tuesday, 10th March.
Bamford v. M'Plterson. Claim of £27 on an 1.0. U. and interest. Mr. Copland appeared for the plaintiff ; Mr. M'Coy for the defendant. The signature of the defendant was proved; but Mr. M'Coy argued that no action could be maintained on an account stated between partners, unless it was a final account. The plaintiff and defendant were partners in an agistment paddock, and an 1.0. U. is merely evidence of an account stated* Judgment reserved.
Pearson v. Draper. — Claim of £5 for trespass on several occasions by cattle of the defendant on the crop of the plaintiff. Mr. Henderson for the plaintiff ; Mr. M'Coy for the defendant. The evidence was conflicting in the extreme, and called for severe remarks. Eventually judgment was given for 305.; costs of Court, 95.; and professional costs, 21s. Ryan v. M'Alister. — Claim of £17 for damage caused by trespass of the cattle of the defendant on crops of plaintiff. Mr. M'Coy for the plaintiff ; Mr. Henderson for the defendant. The trespass was not denied, but a wide difference of opinion existed as to the amount of damage. Judgment was eventually given for £2 10s. and costs of Court, 17s. Jtyan v. Corry. — Claim of £8 for damage caused by the cattle of the defendant trespassing on the crop of the plaintiff. Mr. M'Coy for plaintiff ; Mr. Copland for defendant. The trespasses were proved. The evidence was as usual conflicting as to the amount of damage. Judgment was given for the plaintiff for £3 ss. 6d.; costs of Court, 215.; professional costs, 21s.
