Clayton and others v. Clark. — This was an* application to have Clark's agricultural lease cancelled, in the consequence of the discovery of gold. Mr, M'Qoy for applicants : Mr. Mouat for lessee. - # Mr, Mouat objected to the application on the ground that it was made under the existing Regulations, and the lease - had been granted under the. Regulations of 1864. He also pointed out a reservation in the lease by means of which the objects of the applicants could be effected without cancellation, and handed in two applications for leave to mine on the ground, in terms of the reservation. lie said, in reply to the Warden, that he declined to enter into the merits of the application, and that Mr. Clark was quite willing ifi allow Clayton and party to avail themselves of the reservation in the same way. The Warden directed Clayton and party « to put in a similar application to those put in by Mr. Mouat, and fixed Wednesday next for hearing and finally dealing* with them. In the case of TuUy v. Jum King and others, the Warden gave judgment for the sum of L 5, with 40a cost, and 21s professioalfee.
