Salt Lake, December 2nd. — Brigham Young was arrested this morning at his residence in this city, by the United States Marshal, on a charge of murder. He, iv ouetody of the United States Marshal, accompanied ,by George A. Smith, Daniel H. Wells, H. D. Clawson, and other High Church dignitaries, appeared before Chief Justice M'Kean this afternoon. Tho Courtroom was crowded to suffocation. Much anxiety was evinced on the part of ths Mormons, but not the least show of disorder or disrespect to the Court. The Hon. C. H. Hempstead and Thomas Fitch were counsel for prisoner, and United States Attorney Bates for the prosecution.
Hempstead moved that the prisoner be admitted to bail, on the ground that he was an old man of seventy-one years of age and in feeble health.. He had come four hundred miles to meet this and all other charges, and his physicians certified that imprisonment would imperil his life. Bates offered no opposition to bail, but suggested that if bail be taken, it should be fixed at 500,000 dols.
Judge M'Kean, in his decision, said — The Government of the United States had no gaol in this city for holding prisoners arrested on processes issued from the United States Courts. The Marshal is required to exercise the discretion which the law vests in him. Sometimes such prisoners are kept at Camp Douglass, but the commander of that post is not obliged to receive them. The prisoner is reported to be the owner of several houses in the city. If he chooses to be put under the control of the Marshal in some suitable building, or portion of building, it will be for the Marshal to decide whether to accept it. It is optional for th 3 prisoner to make such offer. In any event the Marshal will look to it that every comfort be provided for the prisoner, remembering that he is an old man. I decline to admit the defendant to hail.
On leaving the Court, Brigham Young tendered the Marshal his residence on South Temple-street, which was accepted, and the prisoner drove him to his own house. Bri^liam was perfectly cool and unconcerned.
