WASTE LANDS BOARD.
A mectingjof the Waste Lands Board was held on the 29th ult. There were present — the Chief Commissioner, Mr. J.T. Thomson, in the chair, and Messrs Eeid, Duncan, and Hughes. The Board considered the notice given by Messrs Smith and Andfrson, solicitors for Mr. Joseph Clarke, of his intention to apped against a decision of the Board on the loth ult., respecting application for 45,500 acres on runs 215 and 212 b The consideration of the cas^e was postponed till Wednesday, the 31st inst. A meeting of Waste Land Board was held on the3ofch ult. There were present — The Chief Commissioner, My. J.T. Thomson, in the chair, and Messrs Eeid, Duncan, and Hughes. Mr. W.S. Eouglas applied for extension of time to survey the area of the ground applied for as an antimony mine at Hindcn. An extension of three months was approved of. An opinion was read' from the Provincial vSolicitor respecting the right of the Corporation* of Balclutha to interfere with the erection of a mill on land there leased io Mr. Doull by the Board* and also a loiter from the Town Clerk of Balclutha on the same subject, complaining thai the Municipal Council had nob been consulted. It was stated that the Board could not consult the Council in the matter, as the Municipality had not been created at the time of granting the lease to Mr. Doull ; also, that the Bo.rd, as advised by the Provincial Solicitor, were of opinion that they had not exceeded their powers. The application of Messrs Mollison and Kilgour :or a lease of their run, No. 275,- Madura district was postponed. A question was read from Mr. E. P. Cocker, respecting commission charged by auctioneer on improvements on sections sold at Ettrick. It was resolved that a circular be sent to auctioneers to remove doubts as to the sums on which commission woulcl be chargeable. The application of Mr. C. T. Marie for a coal lease of 4 acres, at Dairy Creek, near Clyde, was referred to the Warden. A letter was read from Mr. Chappie. regarding his claims for commission, and it was resolved that the claim be not -agreed to. In the matter of Mr. Clarke's application, it was resolved that the Board should decline to consider any case submitted for their approval unless the balance of the purchase money were paid wifchiu the time limited. The following minute was also agreed to :—": — " The decision 1 of' the Board having been disputed upon certain questions at law, arising upon the facts and circumstances attending the sale to Joseph Clarke of lands situate on runs 215 and 212 b, and arising upon the decisions of the Board regarding the same — Resolved, that a case stating the sad facts, circumstances, and decisions, and the questions of law on which the Board requires guidance, be submitted for the opinion of his Honor Mr. Justice Chapman, pursuant to the provisions of the 6th section of the Waste Land Boards Appeal Act, 1867."
