Monday, June 12. assault case.

Chung Lung v. J. C. Roberts. — Mr. M'Coy for plaintiff, and Mr. Copland for the defendant. Damages laid at £20. Mr. M'Coy stated the case as follows : —Chung Lung and party received permission from the Corporation of Lawrence to mine on some ground at the junction of Wetherstones and Gabriels Creeks, the same being within the Municipality. On the 6th of June the defendant Roberts came in a great rage, and attacked them savagely, damaging machinery, and throwing wheelbarrows down upon Chung Lung, and severely injuring his hand. Whereupon the plaintiff and party were very much terrified, and left the claim. They have not worked since. Chung Lung, sworn, deposed — On Tuesday, the 6th June, myself and mates were working at the junction of Gabriels and Wetherstones Creeks. We had permission from the Corporation to mine there. The defendant came to us in a great rage, and ordered us off. He knocked about our machinery. My hand was hurt by defendant putting two wheelbarrows down our claim. My mates were not hurt. On Wednesday we .went to work again. The violence was again repeated by defendant. We have been too much terrified to work since. Three other witneases were called, who corroborated the last witness' evidence. Lawrence Holmes, Town Clerk, sworn, said that the plaintiffs made application to the Corporation for permission to mine on the ground. It is within the Municipality. The Corporation granted permission for them to do so, or rather a promise of non-interference, providing no injury was done to the creek. J. 0. Roberts, defendant, sworn, deposed — I am a publican. I reside in Ross Place. 1 know the place where the Junction Hotel formerly stood. Part of the flooring is left on the ground. The plaintiffs broke it all to pieces. I shoved the barrows over with my foot. Ido not know where they fell. His Worship said it was not in his jurisdiction to say who had the best title to the ground. As regards the assault, I shall only give Is damages, and costs. * ■ •
