RESIDENT MAGISTRATE'S COURT, TAPANUI.
{Before J. N. Wood, Esq., R.M., and VV. 11. S. Roberts, Esq., J.P.) Saturday, May 6. Cameron v. Sheddan. — This was an action against Sheddan for driving seventy head of cattle across the Spylaw Run on the 27th April, 1871, without giving notice. i John Cameron, sworn, said — I am manager on Spylaw Run. On the 27th April last, Sheddan drove seventy head of cattle from the Beaumont to Mr. Roberts' boundary at Spylaw without giving notice. I believe the cattle were Air. Lancaster's cattle. I received a notice through the post stating Mr. Lancaster intended to drive a mob of cattle through the run on the 22nd ultimo, but no notice from Sheddan or Lancaster that cattle would be through on the 27th April. W. M'Kay. sworn, said — T keep the Dunrobin Hotel at the junction of the Switzers and Teviot roads on the Spylaw Run. I remember Thursday, the 27th April last. I saw the defendant driving a mob of cattle, say sixty more or lessthere might have been seventy or a hundred head. I cannot swear how many. I had no conversation with defendant as to the cattle. I believe they were a mixed lot of cattle. Fined £17 10s ; costs, Cs 6d ; and expenses, £2 2s — in default distress, and in default of sufficient distress, two months' imprisonment in H.M.s Gaol, Dunedin. JTm,. Strum v. Francis Frank. — Claim, £9 10s. No appearance of plaintiff. Case dismissed. Wm. Strean v. Thomas Posten. — Claim, £9 sd. No appearance of plaintiff. Case dismissed. j James Smyth v. J". F. Kitching. — Claim, £2 4s. Case dismissed. 21s costs against plaintiff.
