RESIDENT MAGISTRATE'S COURT, DUNEDIN.

Thfrsday, 16th March.

(Before A. Clietham Strode, Esq., 8.M.)

Eegina (on the information of Henry Driver) v. M'Leod. This case was adjourned until the 21st inst.

Regina (on the information of Henry Driver) v. Dick. Mr. George Cook intimated that it was intended to withdraw the case on the defendant paying costs. The information was withdrawn, and the case was dismissed.

Eegina (on the information of James Macandrew) v. Dick. Mr. B. C. Haggitt prosecuted. The defendant, John Dick, printer, Dunedin, was charged with having unlawfully printed and published, on the 4th February last, a cei^ain false and defamatory libel, (namely, the letter which, has already appeared in our columns.) After Mr. Haggitt had opened the case,

James Macandrew, Superintendent, gave evidence to the effect that he had had no dealings with Mr. Driver, pecuniarily or otherwise, until within the last three or four months. He had never received money from Mr, Driver, either in the shape of a bribe, a loan, or otherwise. He had not given Mr. Dick (the defendant) any assurance that these proceedings would be discontinued, nor had he authorised anyone else to do so. He told Mr. Dick that he did not wish to act in a vindictive spirit, but that in justice to himself the matter could not be allowed to rest as it stood.

Henry Driver, auctioneer, stock and station agent, said : He was subpoenaed to produce a memorandum signed by Mr. Dick (the defendant). The memorandum produced and signed by the defendant was the memorandum. The placard shown to him was the placard referred to in the memorandum. Witness read the memorandum refen-ed to, which was a letter from t"he defendant, expressing his unqualified -regret at having been the means of unintentionally injuring Mr. Driver's character by the publication of the letter, in the shape of placards, which gave rise to the present proceedings. "Witness continued :He knew Mr. Macandrew on the 6th. Dec, but not intimately. He scarcely knew Major Croker at that time. He never

combined with. Mr. Macandrew to remove Majoi Croker from, his office Had never suggested to Mr. Macan-* drew to send a " townie " of M'Lean's to Lawrence, as Warden, in place of the Major. Did not write the letter of which, the placard purports to be a copy,

Mr. Haggitt said that he did not at the present time propose to call any further evidence.

The defendant was remanded until Thursday,
